Hilarious to me that he is making his yearly Christmas begathon a 'reward' by the way. There is no chance in hell that he would skip that begathon. If he doesn't hit the goal, he'll just make up some excuse and do it anyway. He knows it's always a good source of money.

I'm old enough to remember not all that long ago someone allegedly inquired about using clips of his and he wanted all kinds of money.What Phil doesn't understand to this date is that fair use doesn't work the way he thinks it works. When you buy a game you are not buying the game and it's content is not yours to use for whatever use. You are buying a license agreement stating that you have the right to PLAY the game but nothing about streaming it nor anything about monetizing the game. If game companies want to they could take down everyone's videos of them playing a game if they want. They don't because it is free advertisement and doesn't harm the companies in any way. Of course Phil wants to say he adds commentary so it's fair use but adding snorts and goat laughs doesn't really count.
But Phil isn't being claimed for gameplay but for the music. Again what Phil doesn't understand is that licensed music is leased to the game company so they can use it in their game. However, under the pretext that the gamers won't be streaming it or making money from it but just playing the game. These songs are ONLY licensed to the game company and no one else. All because you buy a game doesn't mean their contract with the music company transfers to the player. So the music companies have the right to claim any content using their music without their permission. It is like if I buy a song on Itunes then stream the song and claim I bought it so I have the right to do this. WRONG, you have the right to listen to it but not use it for streaming especially one where you make money.
There is a reason why TV shows and movies make their own music and even add fake games to their stuff because using gameplay or music where you don't have permission to do so, especially on something where you make money from is a no no. There is a reason why gaming companies are using Streamer Modes because they know their music licenses don't transfer over to the players. And I doubt a gaming company is going to pay a higher licensing deal to the music companies to let streamers gain rights to stream the game with the licensed music. I wouldn't be surprised if in the future that gaming companies or music companies make weird agreements with streamers to play a game with licensed music without issues but I doubt it.
Please note I don't like how copyright works in favor for music companies and that they have different rules but it is what it is. Phil being in this industry for 13+ years should know this stuff. But in his mind all because he adds his snorts and goat laughs that it's fair use.
TL;DR Phil is an idiot and doesn't understand fair use or music licenses between game companies and music companies.

Well... all these erroneous images I've posted gave me time to think that maybe Phil is just weird and staggeringly ignorant.
And maybe a series like Yakuza that often exaggerates and satirizes elements of Japanese culture is no more an accurate reflection of Japanese culture than GTA is an accurate reflection of American culture.
