Lolcow Melinda Leigh Scott & Marshall Castersen - Sue-happy couple. Flat earth conspiracists. Pretending to be Jewish. Believe Kiwi Farms is protected by the Masonic Order. 0-6 on lawsuits. Marshall is dead.

Okay, so is Mel saying she doesn't want to participate in the hearing coz she is preggers, or is she asking for a delay?

How close is Joshie to getting a favourable outcome here?
A hearing was scheduled and immediately cancelled because it inconveniences both parties. There is no mediation, the judge will decide based on filings already submitted because he's tired of this nonsense.

I imagine he's none too happy mel requested demanded the hearing in the first place and said nah.

Isn't that what the judge asked for and Melinda refused, using her pregnancy as an excuse?
About none of that is in any way accurate.

Read this.

Mel asked for two hearings back in october of last year. The judge recently granted it, and directed the clerk to schedule an appropriate time. Null raised an issue that he couldn't attend, and likewise neither could Mel (because she is pregnant).

Are you talking in time?

Not that closely this year, I am just waiting to hear if it is good news or not for Josh.
Well, to bring you up to speed, the Appeal started in September of last year. You can catch up on the docs here.

I was wondering when the judge would make a ruling about whether Melinda needs to pay a bond
Whenever the judge wants to. Given that there was recent active interest by the judge to resolve this, I optimistically say a ruling should appear soon

I am just waiting to hear if it is good news or not for Josh.

So far, this new ruling isn't bad for Null, and probably would be cheaper than the alternative.

So if Melinda doesn't want to do mediation, does Joshie "win", or does this just bring about another long delay?
I think you confused our favorite liticows. Mediation is on the table in Russhole's copyright case. Melly wants nothing less than a clear win.

I have a feeling that she wasn't too pregnant for the hearing until she found out that Josh would not be attending in person. Just a hunch.
I don't think you are wrong. After all she admitted she craves some "quality time" with Josh.

Melindas kids are going to be crawling around in their own filth like a bunch of feral animals while Melinda is frothing at the mouth like the rabies infested idiot that she is when this is resolved in Nulls favour and she owes him thousands of dollars.

Remember Melinda, no matter how bad it gets, it's never too late for you to kill yourself.

I mean, it'd be easier to follow if CourtListener got their shit unfucked and made it easy to follow the appeal.
It's not really CL's fault. The PACER/ECF sites for the various Circuit Courts are themselves weirdly fucked in different ways, and often really finicky to query. Also the client doesn't upload. I'm not sure whether they've deliberately broken it or just haven't implemented it.

It's somewhat frustrating as these are the cases that actually make law.

Lexis and Westlaw do better at these dockets than the federal appellate courts (as if I am paying their rates for this).

On the good side most of these sites (maybe all I am not going to check) often have a page for recent briefs so if that's all you're interested in, you can get them for free. Another good aspect is they usually have an appendix with submissions from both parties. This means you can get the entire relevant trial court document in one document (or several if it is multi-volume), but the prices max out at I think $3 a document, so you can get the trial court record while only purchasing a couple documents.

Oh, I fully assumed that the issue was the PACER site being weirdly fucky in its own special way that the people over at CourtListener haven't written special code to handle yet. Still, it'd be nice if they did.

New docs. Mel appeals the order that denied Mel's motion for Show cause, and the order that denied the hearings
