I wouldn't be so sure. If that bat was a stunt, there wouldn't be a real person facing charges for this. Maybe whoever it was just landed a shallow hit.

If you're a Christian and you don't like what's going on then say something but you have to realize that your religious views shouldn't intrude on the secular world. Whoever did it should be prosecuted, but if you go around acting like a complete piece of shit all the time, it's going to happen to you eventually. I think him being a complete piece of shit should be at least partial mitigation for whoever clobbered him.

Im not sure if following teenaged girls around screaming "you deserve to be raped" falls under "fighting words"...it would really depend on the situation. Like, if some random guy started following me around in an alley screaming about rape, I could conceivably hit him with a baseball bat and make the argument that his speech could have made me fear for my safety to the point where responding would have been self defense I guess. Not sure that would apply in this case though.

Most places have crazy street preachers who act like this. I doubt anyone thought this guy was anything more than an offensive, ranting asshole. The dude actually addressing him pointed out he'd like to kick his ass, but he didn't actually do it. A baseball bat to the head is almost certainly not a justifiable response (at least legally).

The person who did it is potentially on hook for second degree assault. That's minimum 3.5 years in person.

This guy can be an entertaining salt miner sometimes, like a religious version of Sam Hyde, but it's pretty funny that he let his guard down thinking he was untouchable. There's really no greater failure or humiliation for a member of the right wing than publicly getting clobbered by a liberal when you were asking for it.

Now, if someone stumbled upon something he would find embarrassing and they focused on that instead of the "you deserve rape" shtick, then the salt would really begin to flow. "I went to University of Arizona while he was a student there. He was preaching out on the mall pretty much every day and it was the same usual hateful and gross stuff. But the really weird thing was that if you ever talked to him when he wasn't standing out there yelling at people, he actually is a pretty nice guy. I mean I hate what he does, but when he isn't standing in front of a bunch of people yelling, he seems like a normal guy. He just genuinely believes through his twisted religious world view that he's doing everyone a service by going out there and shouting at everyone. I also had a class with a guy who said he got arrested at the mini riot that happened after we got eliminated from the Elite Eight and he ended up in the back of a paddy wagon with Brother Dean and while they were both handcuffed he started head butting Brother Dean because he wouldn't shut up about Jesus and how everyone was going to hell."
