I think Nick knew legally exactly what he was doing and what he was saying when he made those statements. As well, his dare to Monty to sue him over it. It was deliberate and he thought he could get away with it.

Nick's legal mistake was making a whole lot of assumptions about what Monty could do that turned out to be false. He certainly never expected him to be able to hire an attorney or to file the case in Minnesota making it just about impossible to get a jurisdictional dismissal. Monty turned out ironically to be more capable legally in the client role than Nick has.

The next lesson Nick is going to learn is on the issue of why a person should not make public comments about their ongoing litigation. Nick has already made his deposition and potential trial testimony into disasters. I think he said enough really foolish things that he is danger of meeting the "actual malice" standard even if Monty is declared a public figure.

Nick has effectively given the other side maybe five or six unofficial depositions already. He answered the complaint point-by-point on stream. He has talked endlessly about his motives for the defamation which is madness.

He also appeared to confirm getting shower calls from someone - which sounds almost certain to be Rekieta - saying he got texts whenever he mentioned @elb or Kino Casino on his show.
