So, Nick was given some simple steps to complete in order to get his kids back under his roof. He has refused to complete the steps, pushed back the original court date to determine custody, and the only thing he’s done has been to visit his children (presumably) while they are wards of the state. Counting being emergency mandated to stay with one set of grandparents, as wards of the state, as that is what all of Nick’s children legally are. They will continue to be so until this matter is resolved at trial at the end of August, & something more permanent will then be decided for the next months.

Nick has chosen to pull bullshit theatrics instead of take a drug test & release the results to the court. His kids are missing birthdays, holidays, everything, and Nick is busy with his bullshit refusals, gump haircuts, & social media obsessed lifestyle. He could have done a few little steps to bring his children some comfort & normalcy, but no.

Here in the UK, the courts can't mandate rehab. People generally agree to enter as part of a plea deal. I bet the US is the same. First couple of possession charges for personal use quantities, nobody's giving much of a fuck. You'll get a fine or probation. People tend to take the rehab deal when the alternative is likely to be a custodial sentence. Even though Nick's been collared for an ounce, I don't think anyone is making the argument that he's supplying, so it's still personal use. Not much chance he'd be getting a custodial sentence.

I think it's all about the child protection case and the public relations.

I think the state really just wants to put him on a leash with his children as a carrot, but Balldo is balking.

There are CPS cases which have questionable motives and questionable behavior by the government. But this isn't one of them. Nick got CPS busted for having a pile of coke in his bedroom and having a very young child of his test positive for coke. CPS removing the children from the home and requiring the parents do a relatively straightforward set of probation-like activities is utterly normal. There is no sign in any of the reports of CPS lying about anything or that there would even be subject matter for them to lie about. This is about the most ordinary by-the-book CPS drug case there is. They have not made any unusual demands of the parents and they have provided them with a rather obvious easy path to getting the kids back.

Actually, I don't know if that's a good example. It was established much earlier in the thread that under Minnesota rules, you are entitled to one (1) judge change, no questions asked, if requested within a certain time (30 days from assignment?). I think they had to grant his request under the strict letter of the rules.

Rather than anybody here having to show how fair the State is being to Nick, it's incumbent upon Barnes to explain what corruption he's talking about. Because I don't see it. Apparently, nobody other that he does either. Barnes is talking out his ass, as always.

Any actual competent attorney would be advising Nick to A. Check himself and Kayla into rehab, and behave. And B. Do everything CPS says. Because doing this not just gets his kids back. But has the greatest chance of getting the DA and Judge to agree to some sort of suspended sentence program on the criminal.

Trying to prove he didn't do cocaine. There was no cocaine in the kid. When there is 26 grams of coke spread between 2 safes and every flat surface in his bedroom will accomplish nothing. Well nothing except piss off the Judge Jury and CPS Judge. His Trial isn't going to be weeks long, calling forensic experts and shit. The Judge isn't gonna go for that.
