It's not just about training, I don't know about Minnesota, but where I'm from the only people who can give testimony as to someone being drunk from their behavior alone are police. Others who give evidence would instead have to say they were behaving like they were drunk.
This alone is not enough to convict someone, of say drink driving, without additional evidence from testing, but the point is that it allows the police to then use that as a basis to require a breathalyzer test.
The point is, it serves as a bit of a legal fiction. Plus, the standard of evidence for the warrant isn't reasonable doubt - it's basically preponderance of evidence, and for that purpose, training on these sorts of behaviors would suffice even if imperfect.
Sure, and that is probably good enough for an EMT to deliver meds or a cop patting down a public intoxication case on the sidewalk.
I can elaborate on the EMS side.
Cops tend to do the bare minimum training outside SWAT paramedics so that's EMR if at all (They don't wanna bother). Very basic retard stuff so they wouldn't know too much about seizures or strokes.
EMS is not allowed to "diagnose" (This is a touchy subject), we're allowed to treat
according to standing orders of a doctor who signed off on protocol, the state's standing directives, and under the medical direction some poor shmuck ER Physician on call that day. In other words, compared to a doctor, we prescribe (not under our name, technically under the Medical Director, an MD) very limited medications, we cannot treat outside of our scope of practice (Eg: Diagnose a brain tumor versus a guy's hand being amputated) nor in a manners not-approved. In most states EMS may not certify a person is dead. You'd have to have a really good justification to deviate from protocol and usually if you don't, call the Medical director lest you get assfucked liability wise. Do medics do nonstandard shit all the time? Yes, sometimes everyone turns a blind eye if it's not insane like chopping off someone's arm because they nicked their finger, or just because the standard is outdated. Some EMS organizations I wouldn't trust to suck dick for cock if they were a troon.
For example. An EMT-B is not allowed to prescribe or start IVs (without other licensing usually, depends on state). If I, a theoretical EMT-B, am the only responder in say, 2 hour range (unlikely) of someone with bloodloss because our paramedic got killed dodging stray (coke) bullets (an experience only Brazilians or Ukranians can relate to) from Balldoman while trying to start an IV on a bloodbag, I could call up the medical director (after it's safe for me) and go "Hey, I just lost my paramedic and I need guidance because helps 2+ hours away and this guy is 100% going to die with my current scope of practice". To which the MD might tell me to do something I would not be normally authorized to do.
Hint: Just because we aren't allow doesn't mean we don't know how. I have started many IVs because the hospital/Ambu was short staffed. YMMV
Also in our paperwork we wouldn't just write "Mr. Slave showed signs consistent of alcohol intoxication", it is too vague. But we also aren't cops and hate paperwork too, so we would ideally write "Mr. SLAVE showed ataxia, slurred speech, alongside the smell of alcohol in their breath alongside a prolapsed rectum from anal fisting, while MR. VANDARKHOME had a latex glove on his left hand stuck inside the rectum of Mr. SLAVE while having 300 bucks inside his jabroni outfit causing friction burns on his testicles".
If the lawyer asks "Mr. JOCKSTRAP, you fucking retard, what the fuck does this indicate?" My response would be "What's written in my run report is what are the signs/symptoms I observed".
tl;dr: In short, EMS doesn't get paid enough (Like 10-20 USD/hour lmao) to get sued for malpractice, toss the responsibility to the RN and MDs.
