Until we find a repeat instance of when Nick told the story, this one doesn't imply her being cornered at all, merely pulled aside or just approached.
Yeah, at worst, that's Nick pulling a "whining off the record about what already happened" instead of bringing it up at the time it happened.
Incidentally, here's the motion Nick made to give the defendant nothing but probation and a few other such documents. I don't know Nick expected this to fly.

I would just add, Nick is a lying liar who lies. He's also a coward. He may never have even commented to judge Fischer at all. But boy, did he think about it!
To my credit when I've seethed about this story I multiple times suggested that Nick had actually made it up because he thought it made him look good, but apparently the elevator part is one I at least helped make up.
