According to the warrant, the troubling thing was just how often he was talking badly about her - which is fair.While they clearly want an order restraining Aaron from "harassing" Kayla by talking publicly about the polycule, what happens if they're unable to prove he shared the photo with the intention of harassing Kayla?

If they're unable to prove the intent of harassing Kayla, then it's a gross midemeanor rather than a felony. They've charged him with both and I guess they'll figure out which one they can get to stick.

The problem is if Aaron's been truthful, and hasn't been sending messages to the qover since before the arrest, how is it harassing? He hasn't talked to April at all except through lawyers. If what he has said on his show is the truth, can that be harassment? It has been relentless from Aaron. The only thing Aaron needed to do was say "this is an active case and I may never be able to talk about it - even though I'd like to" and then shut the fuck up forever. He is incapable of doing that.
Also, Aaron is the only first-hand source for the swinging stuff about Nick. We would not know about the existence of the Qover or that they all slept in the same bed or swung with each other. Without Aaron saying it, it was just insanely wild speculation and the Rekietas would have looked like they were just helping out their friend April. It's all Aaron, and he's been trying to squeeze out every bit of detail and emotion he can from this saga so he can keep hitting that goal. He has literally run out of stories.
I'm sure Nick is petty and wants to get Aaron back, but he's been publicly very vague about Aaron. "I hope he gets a million dollars" and that sort of thing. He's going to absolutely reem him with defamation lawsuits if he manages to avoid prison.
Plotwise - it's the most interesting outcome if Nick gets away with everything and then starts a legal battle with Aaron. But, I'm here for whatever turn happens. Everyone sucks here, and there are no heroes. Enjoy the fireworks.
