His attitude must be that nothing he does will take away the possibility of a plea deal, so it doesn't hurt to take any stupid long shot chances available. Ultimately, even if this fails, the plea deal will always be his escape rope out of this cavern in his mind.
Sure, but taking long shots is a luxury Nick can hardly afford. He is already paying for 4 separate legal proceedings on top of his degenerate lifestyle, and it looks his savings are dwindling.

I think maybe the issue here is that the harshest they can seem to punish him is with a four year suspended sentence. @AnOminous mentioned they can ask for an upward departure, but they'd have to justify it. Not that they couldn't, but it is difficult.

You'd think that Nick would maybe wanna knock it down to a year or two suspended, but maybe he feels like if there's no realistic chance of prison he can just be a complete asshole and fight till the bitter end with little risk.
 
What I don't get is why can't anyone in his circle tard wrangle him into submission. Nick's parents aside, Kayla has family too. Her own sister was concerned enough for them to report them to CPS. April strikes me as someone with at least a tiny amount of pragmatism and self-preservation. We're going to find out soon enough whether Kayla is going to accept a plea deal and whether one has been offered to April. Neither of them has the financial resources to fight their charges in any meaningful way, so Nick (and, by extension, Celeste and Bob) will have an outsized influence on their decisions.
 
It was a very short stream. Basically, Uncivil agrees that Rekieta's petition is unlikely to be accepted. The part I found interesting, which I don't remember being discussed in this thread, is that the fact Rekieta raised this petition for discretionary review indicates that he hasn't secured a plea deal yet (despite his admission to doing "mountains of cocaine" on Twitter). I'm not well-versed in legal matters, so this was probably obvious to everyone else.

Nick is appealing to get the Franks hearing heard. That's highly unusual and frowned upon. Appellate courts prefer not to overrule a judge (Wentzell, in this case) until a case is concluded. Everyone in that thread is laughing at him.
This is especially the case for evidentiary decisions, which are rarely overruled even when appealed in a timely fashion. As much of a Hail Mary as the initial Franks hearing request was, this is absolute retardation in comparison. It's just the squalling of a brat denied his Transformer.

He praised their coding skills in Roblox and musical talents, and he said he suggested that they might make a career from it.

It gets easier if you have a full trial on all the charges. At that point, aggravating factors start to pile up on the record. If he pleads to just a drug count and the child abuse/neglect thing goes away, none of that is established on the record. At that point, with no mitigating factors I can see other than "first time offender," and aggravating factors like harming children, I can see them at least considering upward deviations and consecutive rather than concurrent sentences, etc.

Unlikely, but if they do feel energized enough to go the extra mile on it, he's pretty fucked.
