Believing your work is fair use has nothing to do with the person being clipped. I´m explicitly talking about Elissa´s work; she was clipping Nick before the State of the Balldo address so I guess she believed the clips were made and posted under fair use.
It doesn't matter what a clipper believes. Elissa's style of clipping always come close to the line because her clips aren't transformative in any way. That they're raw and untouched is what makes them appealing to other creators. When Will Heren started adding commentary to his clips it was annoying as hell.

Nobody needs the stress of a lawsuit, especially not over a single clip, and Elissa doesn't have a strong argument in favour of future clips being fair use. Her sustainable argument for past clips being OK is that Nick publicly gave permission for her to clip his work. He's rescinded that permission now and the only way any future clips of his work will meet the fair use threshold is if they're tranformative.

I take back my previous prediction Nick would settle.

The problem is even if she complies and privates them or takes them down, Google is forever. And that shit can simply be got with a subpoena. And while it probably is not acceptable to use in court, it does tell them where to look for the originals. Also open to subpoena.

And of course the Police and DA would never ever view scrubbing your shit off the internet as a huge flaming red flag that there is more to find.
It's pretty obvious to everyone but him that he's just trying to hide evidence and it's hard to do that if there are copies everywhere. It's pretty fun watching him try to spin it as something else.

The difference is Nick and Kayla doing that while they're still married and bringing it into their home while half of their kids are still young.
