I hope they do read this because lord is it accurate.The prosecutor is probably torn between the righteous desire to crush Rekieta under the mighty wheels of justice or to go light and take Rekieta's plea because he thinks Nick's continued presence might be best possible outcome for the Rekieta children. The focus of the community at large is almost certainly on the kids.
If any of you reading this are officials or even residents of Kandiyohi County, let me help you out: Nick Rekieta is a terrible father. He is also completely unrepentant in spite of the drug use, drinking, and extramarital sex that have saturated the household and scarred the Rekieta children. He will almost certainly drink and use again once he's out from under court- and CPS-mandated requirements, meaning his children will continue to be endangered by his behaviors. Thus, both the needs of the children and the community at large would be best served by imposing the harshest possible penalties on this man. Throw him in prison. Have done with him. Let him rot.

I’ll defer to the Kiwi law partners here, but every time I ran one of Nick’s legal theories past a defense attorney friend of mine that friend found them retarded. Nick was at one time a decent entertainer, but I don’t think he was ever that smart.
I agree 100%. There are people who try to minimize the harm of childhood molestation by saying, "I got molested, and I turned out fine." This is April trying to emulate Nick. A month or two ago he started talking about rare book collecting. In her little junkie brain this will somehow impress him.
Crimes that have a digital forensics component to them take a substantially longer time to investigate and charge. Especially in smaller municipalities that either have to contract out to private firms to look at the details or rely on a larger agency's IT specialists. Couple that with sending subpoenas to tech firms, whose legal departments are going to probably raise objections to certain aspects of the request, it can take many months. Especially if its something small potatoes like this case and not a serious imminent threat of harm like tracking down a kidnapper or terrorist kind of thing. I realize that this will go against the seemingly majority opinion here.
I hope that Nick and Kayla cop a plea, do no jail time, spend a certain amount of time on probation, being held responsible for maintaining a sober, clean home and that they retain full custody of all the children. If the Rekieta family stays in the same general location, the health and well-being of the children will remain under the watchful eye of extended family, friends, the community, and for a time, the State.
Psychologically and emotionally, any damage to the Rekieta children has already been done. The children would suffer greater harm being separated from their parents. The best outcome for them is that their parents stay together, in their same home, and life returns to their new normal ASAP. I do not wish that they now also have to go through the displacement of a divorce.
No matter how bad the parenting was in that home, it is what the Rekieta children are used to and it represents stability and security to them. Children love and are greatly attached to their parents despite their faults. And no one knows a parents faults better than their children. And children have a great capacity for forgiveness, even to their own detriment.
This is what I wish for their children.

This is null and void if there is ever any proof of physical/sexual abuse of children. Only then should the state step in immediately and children be removed until their safety can be assured. I am comfortable with the Minnesota child welfare workers determination that the Rekieta children are in no further danger at this time. We may not like it, and I personally don't like Nick and Kayla one bit, but my need to see them punished is overshadowed by what is best for their children.
It really is a coin flip. Rackets doesn't want that body footage out, which a plea would achieve, but admitting guilt makes him feel like a vampire being dipped in a vat of molten silver.

None of the "rational" members of Kayla's family would have called, then deflects when someone referred to Dan Sletta's FB comment.... and a firm "ok retard" bc Nick is a 12 year-old.

Would be kind of funny if tomorrow they revoke a plea deal and put new charges on him for his recent antics. Though has he done enough to cause the state to revoke a plea deal or are they required to give him one as a first offender?

Pre-trial hearings are excluded from being recorded and/or streamed.

Out of curiosity, have any examples of the legal theory that was bad? Nick was working with a panel of actual lawyers at the time and they never rebuked his theories all that much.
