The prosecutor is probably torn between the righteous desire to crush Rekieta under the mighty wheels of justice or to go light and take Rekieta's plea because he thinks Nick's continued presence might be best possible outcome for the Rekieta children. The focus of the community at large is almost certainly on the kids.

If any of you reading this are officials or even residents of Kandiyohi County, let me help you out: Nick Rekieta is a terrible father. He is also completely unrepentant in spite of the drug use, drinking, and extramarital sex that have saturated the household and scarred the Rekieta children. He will almost certainly drink and use again once he's out from under court- and CPS-mandated requirements, meaning his children will continue to be endangered by his behaviors. Thus, both the needs of the children and the community at large would be best served by imposing the harshest possible penalties on this man. Throw him in prison. Have done with him. Let him rot.

The biggest danger to those kids is Nick. And Nick is still a danger to himself.
The best outcome for all of this would be prison time for him so he can get sober finally as he won't be able to do it any other way than hard time served.

I don't know how likely anyone in the Prosecution's side is going to be reading things now though. But here's hoping they did and that they know what a sack of shit he really is.
 
I discovered Nick during the Rittenhouse trial and due to a pretty easy job I had at the time, watched most of it. I’ll defer to the Kiwi law partners here, but every time I ran one of Nick’s legal theories past a defense attorney friend of mine that friend found them retarded. Nick was at one time a decent entertainer, but I don’t think he was ever that smart.
So Nick was the real Legal Eagle all along.

On a slightly different note, I mentioned other Youtuber, Guntuber Brandon Herrera who is now apparently in serious consideration for the head of the ATF (Yes, really). Major fuckup or not, Nick would have had the people's support in some administrative role.

Out of curiosity, have any examples of the legal theory that was bad? Nick was working with a panel of actual lawyers at the time and they never rebuked his theories all that much.

I agree 100%. There are people who try to minimize the harm of childhood molestation by saying, "I got molested, and I turned out fine." The faggot that Sargon of Akkad was speaking to when he delivered his famous "It depends on the child" line was making this argument. What they fail to realize is that this is how new molesters are created. You got molested as a child, now you're out here championing the MAP cause. You didn't turn out fine, it fucked you up in the head, and you're going to repeat the cycle.

I think homosexuality is caused by both a genetic predisposition and a triggering event. That event could be as bad as being molested, or as seemingly insignificant as being exposed to pornography by an adult or an older kid when you're too young to handle it. You can have that predisposition and never become gay, or you can have a triggering event and never become gay. But if you have both, you turn into Milo Yiannopoulos.

I almost (ALMOST) feel sorry for her at this point. She knows exactly who Melton is, what Melton does and took as far as I remember took an equal amount of abuse/alogging from him as Aaron prior to her leaving Aaron.

Now she has demean herself and buddy up to Melton because he is Nick's newest subhuman friend. She even has to play into Nick's idea that they are going to out to Las Vegas to visit him. She is literally rolling around in garbage now to please Nick. The woman's self-esteem has to have been destroyed and she is pushed down lower than a dog. There is just no way she can "like" or even stand Melton.

For alot of people, I think something this would be the point where they either run away barefoot into the night (Like wife Ronnie eventually did from Phil Spector) or she has a mental breakdown and Raccoons Nick.

Crimes that have a digital forensics component to them take a substantially longer time to investigate and charge. Especially in smaller municipalities that either have to contract out to private firms to look at the details or rely on a larger agency's IT specialists. Couple that with sending subpoenas to tech firms, whose legal departments are going to probably raise objections to certain aspects of the request, it can take many months. Especially if its something small potatoes like this case and not a serious imminent threat of harm like tracking down a kidnapper or terrorist kind of thing. IF they opt to charge him at all it could easily be the end of next year.

Of course watch me type all this out and have him be arrested tomorrow so I look like an absolute dipshit.

close to zero. i'd be surprised if the state really cares enough to go after nick/melton for the hack at all, and i'm not sure if aaron really wants to push for it. i've been surprised before, but still, seems far-fetched.
 
I realize that this will go against the seemingly majority opinion here.

I hope that Nick and Kayla cop a plea, do no jail time, spend a certain amount of time on probation, being held responsible for maintaining a sober, clean home and that they retain full custody of all the children. If the Rekieta family stays in the same general location, the health and well-being of the children will remain under the watchful eye of extended family, friends, the community, and for a time, the State.

Psychologically and emotionally, any damage to the Rekieta children has already been done. The children would suffer greater harm being separated from their parents. The best outcome for them is that their parents stay together, in their same home, and life returns to their new normal ASAP. I do not wish that they now also have to go through the displacement of a divorce.

No matter how bad the parenting was in that home, it is what the Rekieta children are used to and it represents stability and security to them. Children love and are greatly attached to their parents despite their faults. And no one knows a parents faults better than their children. And children have a great capacity for forgiveness, even to their own detriment.

This is null and void if there is ever any proof of physical/sexual abuse of children. Only then should the state step in immediately and children be removed until their safety can be assured. I am comfortable with the Minnesota child welfare workers determination that the Rekieta children are in no further danger at this time. We may not like it, and I personally don't like Nick and Kayla one bit, but my need to see them punished is overshadowed by what is best for their children.

I do not think this is a minority opinion in sentiment, but the minority in prediction of fact. We just believe Nick is too retarded to do the best for his children and family.

It really is a coin flip. Rackets doesn't want that body footage out, which a plea would achieve, but admitting guilt makes him feel like a vampire being dipped in a vat of molten silver.

Would be kind of funny if tomorrow they revoke a plea deal and put new charges on him for his recent antics. Though has he done enough to cause the state to revoke a plea deal or are they required to give him one as a first offender?

We discussed this months ago in the legal thread, but MN has a sentencing guideline chart for offenses based on severity and criminal history that nets you 'points' to move up the case for both severity and history. Nick with the guns and drugs was only up to 2 points and the presumptive sentence was 48 months suspended. Any deal wood likely be in this range, but might drop some of the degrees of the charges.

Revenge pornography would bump him up to 3 and a presumptive short jail term--if charged. This is the newest development, and it might be a sign that MN does not want to put him in prison as a first time offender.

Just a few more months and Nick will claim the drugs abused him instead of the other way around.

I remember Nick did a video with Donut, but it never got released. I honestly think Brandon, Donut and that crew saw Nick for who he was and decided to stay from him.

Something that has puzzled me is Nick has said they once fostered children, but never went into any detail about that experience. I honestly wonder if something happened and they got booted from the foster system. With what we know now it wouldn’t seem outlandish.

And I know you got my point, but just in general - most people aim to be law-abiding and manage their behaviors at least somewhat accordingly, or at least within certain risk tolerances. Or if they do illegal things - even let's say if they do coke - they kind of make a point not to have high-degree commonly prosecuted felony quantities (even in generous Minnesota) hanging around. There's flirting with disaster, and then there's courting it.

As far as I know, he stated or at least implied that they stopped fostering kids once they had one or two of their own. I honestly don't think Nick was up to the same kind of degeneracy back then that he is now. Success destroyed him. He suddenly had virtually unlimited money and an ego the size of Jupiter. If he had never started uploading to YouTube, he'd probably be an upper-middle-class lawyer with a trust fund making enough to be comfortable, having an affair or two behind his wife's back and drinking a few times a week while secretly seething with resentment at the family that, in his mind, prevented him from ever being anything more special than that.
