I'm going to guess that the judge will see a difference between someone who is acting like a practicing lawyer and someone who is literally an actor purposefully portraying a character using drugs. The fact that Al Pacino isn't called Al Pacino during the movie is a pretty big tell that he's not portraying himself. Being on coke was never part of Nick's public persona, the detective watched enough of Nick's show to know that, and to know that Nick claimed he was portraying his actual character and not adopting one for the purposes of the stream. I don't see any reason to conclude that Pomplum misrepresented anything.

The motion argues that using drugs isn't a crime, only possessing them. So even if Nick was high on stream, that doesn't mean he possessed drugs at any time before or after using them. I suppose we're supposed to conclude it's reasonable to believe that Nick hopped up from his desk, raced out of the house to some undisclosed location, did the drugs there, and then raced home to resume his stream, but it's not reasonable to believe that he walked across the room, did a line of blow off April's ass, and then walked back to the camera...

To humor the "diet pills" horseshit for a moment, even ozempic isn't some miracle cure that makes you lose weight that quickly. It works kind of like a gastric band surgery does, in that it just tries to make you feel full so that you'll stop eating so much—but you absolutely can "beat" it if you're enough of a clueless animal that you just keep eating (like Vito apparently did).
These drugs don't radically change your metabolism, or stop you from absorbing calories, or even do much to suppress your appetite.

The facts that an internet celebrity may have appeared to have lost weight, appeared tired, and appeared "strung out" are conclusory in nature and not factual. Likewise, the allegation that April Imholte appeared tired, lethargic, and strung out are mere statements that fail to recite facts leading to such conclusions. For instance, this is the age of prescription weight loss medications. Essentially, everyone is losing extraordinary amounts of weight in a short period of time. However, no independent investigation was done in that regard. Nicholas also suffers from insomnia, yet no independent investigation was done in that regard.

If this goes to trial, her lawyer will absolutely use Nikacado as evidence and it’ll be hilarious
