I'm going to guess that the judge will see a difference between someone who is acting like a practicing lawyer and someone who is literally an actor purposefully portraying a character using drugs. The motion argues that using drugs isn't a crime, only possessing them. So even if Nick was high on stream, that doesn't mean he possessed drugs at any time before or after using them. Likewise, the allegation that April Imholte appeared tired, lethargic, and strung out are mere statements that fail to recite facts leading to such conclusions. For instance, this is the age of prescription weight loss medications. Essentially, everyone is losing extraordinary amounts of weight in a short period of time.
