The Florida Rules of Civil Procedure aren't particularly relevant because this case is filed in a federal court, not a Florida state court. The relevant federal rule is Federal Rule of Civil Procedure 37(e), which states that "if electronically stored information that should have been preserved in the anticipation or conduct of litigation is lost because a party failed to take reasonable steps to preserve it, and it cannot be restored or replaced through additional discovery, the court: (1) upon finding prejudice to another party from loss of the information, may order measures no greater than necessary to cure the prejudice; or (2) only upon finding that the party acted with the intent to deprive another party of the information’s use in the litigation may: (A) presume that the lost information was unfavorable to the party; (B) instruct the jury that it may or must presume the information was unfavorable to the party; or (C) dismiss the action or enter a default judgment."

Thus, the relevant question is whether Destiny deleted those logs when he was "anticipating litigation." I'd argue he was anticipating litigation, or should have been anticipating litigation, at least as early as Pxie announcing the lawsuit on twitter and publishing her GoFundMe, maybe even earlier depending on their conversations. And yes, section 37(e)(2)(A) allows the court to "presume that the lost information was unfavorable to the party," i.e., make an adverse inference, if it also finds that Destiny deleted the information with the intent to deprive Pxie of its use in the litigation.

EDIT: Apparently, the Eleventh Circuit (which oversees federal courts in Florida) has held that the duty to preserve electronically stored information arises "when litigation is pending or reasonably foreseeable."

At the very least it can be argued that he could reasonably anticipate litigation as of January 20th (the day Pxie dropped the substack and announced she was suing him) and much of his deletions have been since then. So I think it will apply from then on, if not earlier.

This is evidence he isn't acting super calculating actually. The theory is that Destiny is making the best out of a bad situation, in theory he is doing it by doing a death march to trial and getting a judgement quickly before Pxie's lawyers have the time to do everything they need to do in order to maximize the possible payoff.

If this is true it is not congruent with how he acts. You really shouldn't delete evidence. If he asked his lawyers they would very much tell him not to do that. He can't both be coldly calculating and acting rationally and doing dumb things that will cause the court to be prejudiced against him.

There's no such thing as deleted messages in 2025. If Discord is subpoena'd they'll provided everything. Something to consider.

Something else to consider is that a DA can use evidence found in civil discovery cases to build a criminal one.

I don't think a criminal case with serious legal repercussions is going to happen to him even if they have pretty good evidence of him committing it. Look at what happened to Ethan Ralph. The thing about Revenge Porn is that prosecutors don't view it as a super serious issue. It is unfortunate but that seems to be the way things work.

Nobody watches pundits for just political education. The information in my college gov and business courses is way more dense than political content I watch on the internet. I like his political commentary because his ideology aligns with mine, he's better at countering opposing narratives than most people, he can accurately summarize what an opposing side thinks (at least when he isn't being bad faith lol), and he caveats the fuck out of his statements so you can have an extremely clear understanding of his positions (again he obfuscates like crazy when he's being bad faith but when I started watching him it wasn't this bad lol).

I'm in support of destiny trolling the guy who got shot at the rally, but when he was on a piers morgan panel he was unwilling to condemn the shooter. Technically you can be autistic and say "just because he didn't explicitly denounce it doesn't mean he supports it", but I liked destiny because of the fact that used to make his beliefs extremely clear, its why I sided with him in debates where his interlocutor would dodge questions, obsess over semantics, obfuscate ect.
