Normally i believe it would be better for pixie if you couldnt subpeona google/discord, since the judge, if stephen refuses to/is unable to provide the chatlogs, can freely infer why this is the case, whoch typically would be bad for Destiny

The metadata of who created the blob storage, when and by whom was it accessed, who deleted it? Naw, that's retained in any sane architecture.

Because he mentioned it yesterday. His Instagram is growing because of reels he pushes. He has hired someone that is posting short videos for him on Instagram, Twitter and Threads.
All other platforms are still losing followers or at the very least stagnating.

But for Instagram he has recovered everything in Followers since Pxie went public and is growing for his metrics relatively fast. He's still barely relevant on Instagram. But he seems to get a decent amount of views there. Probably a couple of millions per month (Is there any site that tracks views for reels?). With his demographic being mostly from western wealthy nations he will probably get about $1 for 1K views (CPM is $5-$10 for Instagram but not every view gets served an ad). That's a couple of thousand $ per month. Still less than his loss of income from AnythingElse on Patreon alone. He lost about $6K in subscriptions per month on Patreon after Pxie went public.

They are definitely available/recoverable after this period, and are merely soft deleted, Discord gets requests from law enforcement and courts regularly. This isn't a criminal case where someone's discord manifesto shows up in the media the following day, and I have no idea how much discord will cooperate or how it will play out in court... but the logs havent vanished.

Are they talking about the federal statute that Pxie is suing Destiny under, 15 U.S.C. 6851? If so, there's no language in the statute putting a "cap" on damages or setting the "maximum" amount of damages at $150k; I don't know what they're talking about. The statute provides either for liquidated damages of $150k (which would be awarded in the absence of proving actual damages), or actual damages, which the statute does not put a cap on. I'm also not sure where Destiny is getting the idea from that the court could award lower than $150k in liquidated damages if Pxie proves he violated the statute.

Sure, liquidated damages are a predetermined amount of money that a party is entitled to, regardless of whether they can prove they actually suffered that financial loss. "Liquidated damages" provisions come up often in contracts, where both parties will agree to a set amount of damages in case one party breaches the contract (that way, if a legal dispute arises, they wouldn't actually have to prove the amount of damages because that can take time and money). So my interpretation of the statute is that $150k is the minimum amount a plaintiff suing under this statute would be entitled to if they can prove the defendant's liability; that's not a "cap" or a "statutory maximum."

Actual damages, on the other hand, is the amount of harm the plaintiff suffered put in terms of a dollar amount. That can sometimes be hard to prove, which is why I imagine Congress saw fit to put a "liquidated damages" provision in this statute. And just to illustrate why I think its so wrong to read this statute as imposing a cap on actual damages: imagine I'm Miss Rachel, and I have a multi-million dollar contract to host a television show for toddlers. Now also imagine my ex-partner distributed private pornographic material of me without my consent to a bunch of people, and such material got leaked. As a result, I lost my multi-million dollar contract, and I couldn't find equivalent work. So I sue my ex-partner under this statute requesting compensatory damages, in part, for damage to my reputation, including losing that contract. Why should we think the court would limit my actual damages to $150k? The statute doesn't say that, and I suffered way more than that. It wouldn't make any sense to limit the actual damages by the liquidated damages amount. If the statute was intended to do that, I'd expect it to say something like "an individual may recover the actual damages sustained by the individual or liquidated damages in the amount of $150,000, whichever is less." But the statute doesn't include the latter language.

Random thought I had--We know that Destiny tried to pay off Pixie, and we know that the "attack dog" lawfirm he hired hasn't done much to help his public image.

Is it possible most of his focus has been on shoring up his legal exposure from the rest of the women he was sharing videos of?

The guy pushed back on what destny was saying and knew a random study he was referencing, then destiny got so assmad after being called out for gish galloping so hard he didn't even know what he just said that he just rage quit the debate saying that Ape was "not equipped for this conversation".

Do you have any proof of this? Everything I have found says if law enforcement isn't requesting to retain specific deleted messages within their backup cycle of 30-45 days the data is not recoverable, not even for law enforcement.

Almost all his debates prior to 2020/21 are stupid. He is arguing in many of them with low information and is googling or reading chat for help to bail him out mid debate.
