Hopefully he's already lost as much as $300k, but I think this is worth pointing out: The likely reason Destiny is mentioning this - both in the affidavit and on stream - is to create a sense in front of his community that retribution has already been meted out. "Maybe he did a bad thing, but it's already cost him twice the max payout! Time to forgive and forget." They'd probably need several witnesses to come forward though, to have any chance of success on this point. I do think Destiny's haphazard sharing with teenagers he only knowns through an online moniker, combined with private material of his having leaked before, strengthens the argument that he should have a reasonable expectation of it reaching the public, but they probably still need like half a dozen people to come forward.

The main reason Destiny is in legal trouble is because there's a question of whether Pxie adequately consented to Destiny sharing that video of her to Rose. The best argument Destiny can muster is an implied consent. If he had gotten clear consent from Pxie, she probably wouldn't have any case at all. I'm being reductive here, but what these orbiters did (that they now get called snakes for) is ultimately very similar to what Destiny did to Pxie: they (and he) did something that affected another person negatively, and had they reached out to the affected person before they did anything, they may have reconsidered their actions or avoided the worst impacts. If Pisco is a snake because he didn't reach out to Destiny beforehand, is it fair to call Destiny a snake because he didn't reach out to Pxie?
