Presumably the more interesting aspect would be the conduct that led to a restraining order and whether that constitutes a crime with all the caveats about the standard to which that conduct has to be shown to to get a restraining order being far less than that required for a criminal conviction?

It really is wild to see a former attorney being this smug about an ongoing case. He should know as well as anyone that you never really know the outcome until everything is over.
It's been a theme of his since before "the Fall". The Vic Mignogna coverage was full of it.

To be fair I don't doubt that this approach is popular with viewers. It's a cliche that lawyers love using euphemisms when asked, by the paying client, about the likely outcome of a case. You have a case, you have a good case, it's an arguable case, you have a sporting chance, you have a reasonable case, you should win, you're likely to win &c. And clients hate it because of course it's meaningless and often push for something that at least sounds more precise like a percentage. Of course when the case is lost after the lawyer said there was a 90% chance of success the lawyer is not wrong; that client was just in the unlucky 10%. A wiser man than I once told me that you should always add in a fudge factor of between 10% and 25% for "litigation risk" and there was a time in Britbongistan when the Court of Appeal was regarded by the profession as so unpredictable as to justify a 25% fudge factor even on what should be a dead cert.

With Nick he also freely comments in the same way on his own legal woes. It's accepted wisdom not to comment at all on your own ongoing cases but Nick nose better as he does with so many things. Again it's a longstanding thing with him. He declared inevitable victory with his Cuck/Duck Dynasty mini-saga. When it didn't go as predicted Nick just stopped talking about it and, as far as I saw, got away with that one.

One of the big problems is that when a lawyer (or any other expert in a particular field) says what will happen and it doesn't happen, credibility takes a knock. Specific circumstances may make that unfair but patterns are patterns and life ain't fair. If the lawyer declares with absolute certainty what will happen and it doesn't that just makes the impact on credibility all the greater.

I don’t know why, but Nick’s smugness invokes a kind of nigger rage I didn’t think was possible. It’s his absolute refusal to accept that he did anything wrong and he did NOT fuck up his whole life that just rubs people the wrong way.

I’ve only seen like 2-3 people who invoke this kind of nigger rage. Wings of Redemption is one of them, and DSP is another. They refuse to believe they did anything wrong and they will continue to refuse to accept responsibility for their lives. Add onto that, though, the fact that Nick has 5 kids in the mix whose lives are irreparably damaged by his decisions, and it just brings me to a new level of MATI that I didn’t think possible.
If Rekieta’s father had any testosterone left he would have beat Nick to death the moment Balldo entered puberty, just like Nick failed at attempting to do to his own kids but without the limp wrists and noodle arms.

Iirc regardless of if you believe them correcting the record was correct, they didn’t consult the third party Mr. Moon represented by Mr. Hardin. It’s a procedural thing, but I am not a lawyer. Null effectively was acting like a journalist during the Jodie Arias trial or the Duke Lacrosse false rape allegations. On behalf of public interest Mudraker Moon intervened. It’s literally the consent meme, but Null and Hardin unironically have to be heard before shit happens. I might be wrong, but I am not sure if just flat out wrong or only slightly retarded wrong. @AnOminous @waffle @Potentially Criminal would likely be able to correct me.

The first appeal was just asking the same exact judge “are you sure?”. It would be less likely for him to immediately say he was wrong than for him to say he was in the right. The judge was only reaffirming his own decision that he just made. It’s the least meaningful and most expected outcome possible at this stage. As a judge even if he knows he is wrong, he still has to be wrong with conviction.
 
This doesn't make a lick of sense, why would Hardin pursue this pro bono & under his own name rather than Nulls if it's just Josh's' demand for "frivolous action", surely he'd put Nulls name on it and make him pay through the nose for such action - Nicks saying that Hardin is willfully damaging his own reputation on a case he knows he cannot win.
Nick is a weak faggot who tries to bully, cajole and bribe (usually with cocaine) other people to do his dirty work all the time, so he assumes everyone else operates that way. The theory is that Rekieta's family donated a lot of money for a zoo in Kandy Yoshi county that became a major source of tourism revenue (this part I think is true) and that because of it Nick is an untouchable (I don't think that's true)

I think it's far more likely that the court either did an off the record deal with Nick to seal the bodycam footage if he cooperated, the county thinks it'd be a major embarrassment to have a drug den like Rekieta's get out there, or general small town sheriff's office laziness. Possibly a combination of the 3.
