The "He started it!" defense is unlikely to work.

The statute (Minn. Stat. § 609.74 focuses on:

• Whether the respondent engaged in a pattern of harassment,
• Not whether the applicant also acted badly or provoked them.

Nick's best option is to point out that Aaron is the defendant in a criminal case against his wife and the timing of the HRO is a day after he was shown to violate his release terms.

What I'd guess is that the restraining order was largely based on the defence to the revenge porn case he stupidly opted not to fight.

Keep in mind, a Judge has already found that what Aaron alleged met the standard for the temporary order and we know from Nick that what Aaron alleged is true. (He went over parts of it). These orders usually fall apart when it is shown that the applicant lied.

I think we also see from Nick he is ready to lie. He said that he mentions Aaron on occasion? It's nonstop and I know of at least two comments where he has insinuated death is his aim. If that is presented in court, the chances of overturning are slim. If he enters into court seeking to omit the level of his harassment the Judge is going to decide he isn't credible.

At best, what Nick can show from the clips he has gathered is a way for a Judge to say "Okay, both of you no contact". If the last 5 days are anything to go by, that's way easier for Aaron to stick to.

I'm not saying it's a slam dunk this gets extended, as Aaron has a credibility and motive hurdle, but I just point out that the initial granted order is based on a real fact pattern and the "He started it" isn't going to work as Nick seems to think it will.

If Aaron reads this thread, you should lean into those death comments from Nick. Someone reposted them in his thread. It certainly presents that his aim is to make you kill yourself via harassment and lawfare.

So, if Aaron can overcome that big revenge porn case hurdle, that HRO is likely gonna go the two years. I'd predict the Judge will rule that both parties can't contact or mention each other. I think there is a good chance Nick has already broken it multiple times. That also massively boosts the chances of it being accepted, as he continues the behavior under an interim harassment restraining order.

It's currently like watching two retards playing with grenades and trying to figure out who will accidentally pull the pin first. Aaron, through stupid actions, and his habit of opting for the cheap path of least resistance has put himself in quite a pickle. Nick is on probation and violating even an interim HRO is a probation violation, yet at the very very least, he is engaging in the same behavior that bit Aaron in the ass, but even more overtly.
