And I for one am glad to see America Chavez back in action. Yaboi Zack's coverage of the first unsuccessful run was great stuff. Hopefully, the sequel is just as great.

Unironically America's firs run was some of the best comic books I have ever read. It was the epitome of everything that was wrong with the comic book industry and I consider it a piece of art.

Actually it was originally CashGrab when it was gonna be made by Cecil, Tim, and Nerkish and I think it was going to make fun of CG for kicks. Then he changed the name to Backstab when they bailed without talking to him because of shit with EVS, and War Campaign and a bit of nudging from Sashi. So I guess it's still a spite campaign, Cecil just changed targets from Tim and Nerkish to Doug.

It's a parody, he don't need rights for shit. It just needs to be different enough that he doesn't have to worry about lawyers coming after him.
I recall Mel Brooks still had to approach Lucasfilm to make Space Balls, they were given permission with the strict condition that they could not have merchandise of the film. However someone points out later in this thread that Dynamite owns the rights to Rainbow Brite and Ethan and Dynamite have a working relationship, so I don't think he'd have any issues.
So apparently either the writer or the original writer for Red Rooster didn't even get a copy of the pdf that was just released (there's a tweet of that somewhere and there's also this comment on a video I stumbled upon) :

This is quite worrying. Merk Pellegrini is a fantastic writer, the Black Hops series was excellent. He and Tim took what on the surface is an incredibly stupid idea and made it not only work, but work perfectly. I remember Doug Ernst and Edwin Boyette were both sent copies of the Red Rooster: Golden Age script back in 2018 and they were both incredibly impressed and sung it high praise. If 75% of the dialogue has been changed how long until we have Comicsgaters screaming "RELEASE THE PELLEGRINI CUT!"

It always felt like Mitch's true passion project was The Futurists and his heart was never really in Red Rooster. His been working on The Futurists concept for over a decade with his friend Patrick Stiles (a writer with no writing credits). Even one of RR's stretch goals was a preview copy of the Futurists when RR came out, which is pointless now since The Futurist's was given priority and was delivered before RR. I kinda cant blame Mitch for where his passions lie, The Futurists does sound more interesting than yet another capecuck adventure story. But I can blame him on incompetence, laziness, lousy communication and the poor execution of his RR campaign. He should have just made The Futurists to begin with instead of RR, and not generic looking trash like Bass Reeves and Norahs Saga.

You got me nostalgic now. I want to rewatch Yaboi's old videos for her again. I am unironically excited just for the Zack videos, I pray they don't make it so bad that he gives up after one issue, but not so good enough that Zack recommends it, as he sometimes loves to do with shit comics.

Don't get me wrong, despite describing it as another capecuck adventure story, I still backed it because I found it interesting. Mitch's art is impressive (despite how sloppy it is sometimes, the bighead on RR for example) and Bettie's coloring and use of lighting is superb. The setting is ultimately what sold me, I loved The Shadow, Tin Tin and The Rocketeer as a child. The 1920s and 1930s always provide an interesting setting for stories, the aftermath of the first World War, Great Depression and prelude to the Second World War etc. The evolution of a historically agrarian/rural culture into the modern manufacturing based society and the conflicts that arose.

As far as capeshit goes, Red Rooster was at least trying to do something different from generic hero, with generic backstory, gains super powers to fight the generic villain with a cliche motivation. Red Rooster's enemies attempting to destroy his reputation, rather than the hero himself shows that Mitch at least put some thought and effort into his story. Although I must wonder whether this was his idea, or Mark Pellegrini's tbh.

"Fair use" is a doctrine everywhere that has copyright has some version of, but it means you can, without permission, use some portion of copyrighted works so long as the use is somehow "transformative" enough, i.e. changes the original, and doesn't use too much of it or impede the sale of the original work by substituting for it.

Usually, parody is a fair use. However, the issue of whether a particular parody is can be very, very expensive to litigate, especially against people richer than God.

The sheer expense of litigating the issue means you don't want to do it and if you're looking for investors for a movie that parodies a well known property, anyone putting millions of dollars into that is going to want to know it isn't just going to be shut down or end up going massively overbudget because they have to spend a lot of money winning a lawsuit.

And exactly that sometimes happens. One of the Naked Gun movies used a poster that was a parody of Annie Leibovitz's famous photo of a pregnant Demi Moore, except it was a pregnant Leslie Nielsen. Obviously a parody but the bitch sued. And lost. And appealed. And lost. You can bet that was expensive. So it's cheaper to get permission, if you can.

Weird Al also always gets permission because he's an absurdly nice guy.

Looking at IGG’s list of prohibited content, Edwin, Mike, Preston, and Doug could all theoretically get away with the claim that the campaign has “abusive videos”. Doug could theoretically claim “sexual harassment” since Cecil is intent on selling a book using his likeness that makes explicit reference to entering assholes.

Unlike Mike, Doug, or Preston, Edwin isn’t really using his likeness or name to sell a product so he probably has a stronger claim than them.

All that said, Preston showed off in one of his videos that even IGG reps are willing to bend the knee to EVS and his sperg army, so getting Cecil’s campaign flagged seems like a tall order.

Vox's lawyers found a loop-hole in IGG's terms of service that meant technically once a campaign had been successful and had entered the In-demand stage they had no right to take it down or deny funds. IGG ended up settling with Vox for an unknown sum and gave him a guarantee that Arkhaven would be allowed to crowdfund on the platform in future (providing he didn't break TOS.)

I remember he was on a Nick Rekieta stream talking about it months ago, it might have been another video somewhere else but I'm pretty sure this is where I heard him talk about it.


As far as I know Ethan and CG were made aware of this loophole, so I presume the reason Cecil released the second part of the trailer so close to entering the In-demand phase was to deliberately violate IGG TOS without incurring any penalty due to the loophole.

Yaboi, on the other hand, has put out his own offer, willing to buy back up to 1k of unsold/unwanted copies of comics. He's going the retail route of ripping the product a bit and marking it as defective. I can't imagine he will get many takers, namely because he's putting this offer just on Youtube, and I don't imagine a lot of business OWNERS watch Youtube, let alone Yaboi. I am sure there are some, but I think this is where him having a Twitter might have actually helped boost his offer.

His usually terrible tastes. Gail was never a good writer. At her best she was mediocre. If hypothetical woman is the best Justice League story you ever read you haven't read much Justice League. Morrison? Giffen JDM? I know its popular to hate him, I sure did, but Meltzer? Come on.

He isn't talking about filing suit, though, but an arbitration within IGG's own procedures, which isn't subject to the First Amendment.
