Probably not. He's a dumbass, but he's not so dumb as to not realize how fucked he is. He had to have some idea of how much trouble he is in and how much his life would change if he couldn't get out of the charges given that he made the shisturbation video and said that it was proof he didn't molest Amber.

Speaking of...who does Amber live with? I hope she's getting the therapy she no doubt needs. I don't want her to turn out fucked up in her own way like Nick given their parents' and their aversion to psychiatry.
 
According to this Nick is being charged with one count of "deviate sexual intercourse with a child" and three counts of "indecent assault of a child".

If he's found guilty on that first charge alone, he "shall be sentenced to a term of imprisonment which shall be fixed by the court at not more than 40 years."

I think it's 5-10 years for each of the other 3 charges. I'm not to sure about pedo Justice, but I gues there is a chance of 40 years + 30 years. Maybe?

Those are 18 Pa. C.S.A. § 3123(b) and 18 Pa. C.S.A. § 3126(a)(7).

§ 3123. Involuntary deviate sexual intercourse.

(b) Involuntary deviate sexual intercourse with a child.--A person commits involuntary deviate sexual intercourse with a child, a felony of the first degree, when the person engages in deviate sexual intercourse with a complainant who is less than 13 years of age.

§ 3126. Indecent assault.
(a) Offense defined.--A person is guilty of indecent assault if the person has indecent contact with the complainant, causes the complainant to have indecent contact with the person or intentionally causes the complainant to come into contact with seminal fluid, urine or feces for the purpose of arousing sexual desire in the person or the complainant and:

(7) the complainant is less than 13 years of age[.]

The first is the most severe, a felony of the first degree, just shy of a capital crime. The second is a felony of the third degree or a misdemeanor of the first degree, depending on circumstances. The circumstances exist which make it a third degree felony.

So Nick is facing one first degree felony and three third degree felonies. The first degree felony is the most serious.

This statute also has special sentencing provisions.

(d) Sentences.--Notwithstanding the provisions of section 1103 (relating to sentence of imprisonment for felony), a person convicted of an offense under:
(1) Subsection (b) shall be sentenced to a term of imprisonment which shall be fixed by the court at not more than 40 years.
(2) Subsection (c) shall be sentenced up to a maximum term of life imprisonment.

I believe I neglected to note this the first time a couple weeks ago that this came up. The ordinary sentence for a first degree felony is 20 years. In any event, the person who just posted a couple posts up was right about the 40 year thing.

The other three are third degree felonies, with sentence of up to 7 years. So in theory, if you served these consecutively, they could add up to 61 years.

As pointed out, though, they're likely to be served concurrently.

The most favorable likely plea would be to one of the lower charges or, in theory, to some even lesser charge yet like child endangerment. I don't think that's likely for Nick, though. I don't see much incentive for a favorable plea offer.[/QUOTE]

You're right. "I didn't do anything" will be his defense in court. Then they'll see his psych report.

How does one "involuntarily" preform sexual deviant intercourse with a child? How does that happen?
Is that like "oops I fell"??




Edit: the reason I ask is because "voluntary" or "involuntary" is usually talking about the intent of the one doing the act, not the one getting the act. Involuntary manslaughter, for example, isn't saying the person didn't want to be murdered... it's that the person accidently murdered them. So how do you accidentally deviantly violate a 6 year old?

No there isn't, after bail is set by a judge it can be posted at any time. However the defense will inform the court that their defendant intends to post bail when the funds can be raised, the judge can then place restrictions upon the defendant (passport turned in, home confinement, who they can talk to ect....) when bail is made.
 
This might be off-topic now - I'm just catching up on the last nine pages today - but I have some thoughts as to why Nick is in to kids so much.

It's entirely possible he was sexually assaulted as a kid and has repressed memories, but I don't think that's it. I think, as somebody who was fully aware of his mental status in comparison with his peers, he had ( and has ) somewhat of a Peter Pan complex... a fear of growing up. He projects his innermost desires on children. Even when he talked about Anna, he almost always seemed to refer to her as he knew her - a submissive twelve year old. He wanted youth, innocence, and no control over his life. And I think his fantasies reflect that pretty well.

@Dudeofteenage suggested his bathing habits stemmed from assault, and it's a good point. I think that is related more to his schizotypal disorder, though. Depending on the severity of disorders in that general group ( schizophrenia, bipolar, etc. ), bathing is really difficult... not to mention caring about hygiene to begin with.
