Looks like LEGO took down the leaked Lego pics that were originally on reddit and imgur.

So comes down to whether or not they had copyrighted the images, rather than the objects in question. If they had done so though, I'd imagine they'd have sent that along with the rest of their legal jargon.

I believe two prior DMCA request have been filed (and referenced in this thread) with Null replying that the posts/images in question qualify as valid instances of fair use and critique. Still it's a bit odd that after filing two separate and valid DMCA requests -- each with a different case number -- someone else from Lego would submit this message that doesn't even request any type of action be taken.

I didn't know plastic dinosaurs could be lawyers.
Given that Lego sent, in sequence,
  • A message implying a request for removal without filing a proper DMCA request,
  • A valid DMCA request, which Null denied in citing fair use/critique.
  • A second separate DMCA request (to Null as the ISP, IIIRC) in response to first DMCA being denied, and
  • This new message that is neither a valid DMCA request nor requests any specific action be taken,
The dinosaur could very well be the smartest creature in that photograph.

The very first message didn't request anything be done and was actually relatively cordial. Then these two stupid as fuck DMCAs and now this.

I don't think these idiots know what anyone else in their corporation is even doing.

Did they send valid and complete DMCAs though? I don't see any. For a DMCA takedown to be valid it needs to include a list of very specific things. As I look through Lego's messages I fail to see the required statements as listed under 17-512C(3)a- for example, no "statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed." Null seems to be the only one following the letter of the Act.

In rereading Null's OP edited to include all the messages he's received to date, it appears than not even the two messages that have sender-assigned case numbers have a valid DMCA format.

What might have thrown me was two things:
  1. Dear Leader usually doesn't respond professionally to invalid DMCA requests, and
  2. One of his responses included a statement that the response was being made under penalty of perjury. I may have seen that and thought the message being responded to was a valid DMCA request.
I have to wonder if brandprotection @ mm.lego.com isn't assigned to a single person but is instead the generic alias used by Lego's IP staff. All four messages, each with a different approach, have this address appearing as the sender. While it's possible there's a single clueless person on the other end, I can't dismiss the likelihood that multiple staff members are sending these toothless demands without communicating with each other or seeing what other messages have been previously sent and replied to.

I think it's time to start looking for phone trees. Lego has so many employees, so many vulnerable people who could be targeted by vicious cyber bullies.
Given how dumb they are, I think they might merit a community watch thread given that they stopped being a company that can be taken seriously the moment they were too retarded to properly serve a DMCA multiple times and tried threats. Well that and they singlehandedly nuked their own monopoly to bootleggers after they tarded out on previous companies way back when and nuked them.

Seriously, it's one thing to kindly ask and give full reasons as to why. It's another to try and flex on a site because your own staff are too stupid to not leak out stuff you want hidden to preven bootleggers from beating you to the punch for both about the same quality and a much lower price.
