Its pretty clear from watching Ethan's video that the three getting sued were intentionally restreaming Kliens work in order to specifically cost him revenue and views. There should be some laws or rules that prevent people from maliciously taking something you put time and effort into making and then stealing it in order to specifically prevent you from getting money, and yes I am aware you "can't steal a video on youtube." but we all know you can release content in such a way as to fuck someone in the algorthym and minimize the views they get which is as close to stealing as you can reasonably get in the video creation game.

But, the bar he’s established here is extremely high. Denims doesn't just react to the video, she makes political arguments.... which the lawsuit itself tries to debate... proving it's transformative.

That's probably the weakest part of the lawsuit, aside from the 9 pages outlining the Content Nuke for no reason. I expect that to be stricken as irrelevant. But commentary is only 1 factor in fair use analysis, the rest of it goes extremely strongly against Denims.

If you had bothered reading the suit (or any other copyright suit), you might have noticed fair use isn't a binary state, there's four factors that need to be considered:


Providing commentary alone is not enough to show fair use. It has to be relevant to the "substance or style" of the copied work, and again that's not a binary, it's a sliding factor. You're saying Denims' commentary clears the bar, Klein's lawyers argue it doesn't. The court will make the determination, but it almost doesn't matter, because the other factors are a slam dunk win for Ethan.

Denims, being the vapid retard that she is, explicitly said she was doing it so her viewers don't support Klein through views or ad revenue. She did it on her own stream, which was fully monetized and advertised ways to give her money. That's basically an automatic strike against her because her "use is of a commercial nature".

Factor #3 is a slam dunk for Ethan as well. She intentionally watched the entire Nuke in sequence, no clips or extracts. That weighs against any fair use argument she could make in other factors.

Factor #4 would normally be hard to prove... except that there is a visible, measurable bump in Denims' stream numbers. They are clearly there to avoid watching the source video.



Keep in mind that these 4 factors are not co-equal. #2 is less important, #3 affects the analysis of #1, and #4 is usually considered "the most important element of fair use" because it cuts to the heart of whether monetary value is actually being stolen.

So Klein could lose entirely on the question of whether Denims provided "enough commentary" to satisfy that factor, but is likely to still win overall because the other factors weigh so heavily in his favor.

Has Ethan ever asked them to stop reacting to his videos? No! I'm pretty sure he spent months demanding Hasan to watch his video on his stream.

Yeah, and now he is not suing Hasan, arguably the streamer he should hate the most. Hasan did the bare minimum needed for actual fair use, Denims did not. Did you even read the thread?

So it's a very weird thing to twist this into "you're stealing from me without my permission!!!", disingenuous at best, most likely malicious.

I don't know if you're an Ethan a-log or a Denims simp, but one thing you aren't is someone with even a layman's understanding of the laws at question here. Ethan put out a video like normal, Denims stole content like normal, the only shocker is the Jew wants to spend his own money slapping her for it. Consequences following actions is not malicious.
