It’s hard for me to buy into the “this will destroy all free use!” Doomers. I would maybe agree if he cast a huge net and also went after people like XQC and Asmongold.

But, the bar he’s established here is extremely high. He is exclusively targeting people that pretty explicitly said “come watch me watch this video so you won’t give H3 views and ad revenue.” You have to be extremely stupid to do this, even XQC is smarter. He’ll spin slots while playing brainrot to keep his ADHD child fanbase mentally stimulated, but he would never admit a malicious intent to deprive the creator of ad revenue.

Like imagine if someone went live on twitch and streamed the entire newest Star Wars movie, beginning and ending the stream with “thanks for watching with me so you aren’t giving Disney any money.” Everyone would expect Disney to immediately unleash their lawyers to assfuck that streamer and they would be permanently banned from Twitch. Everyone already knows this is what would happen, that person already passed the generally understood line of what is currently considered acceptable.

Maybe I don’t know enough about the legal system, but the precedent this lawsuit would set seems to be “don’t be a retard and openly admit you are view sharking with a malicious intent.”
The truth is ALL react content runs afoul of copyright. The content they produce isn't transformative enough. Just saying "oh wow" or "really" every 5 minutes isn't good enough. And shit like Hasan just going to the bathroom is just blatant.

I'm hoping this lawsuit will really put a stop to react content since all three of them were guilty of doing this shit. As I understand it, there is a matter of degree the court considers so having most of the video just being your little head in the corner probably isn't enough. The malicious thing isn't even a requirement. You can use Youtube analytics to show that they were stealing views from you. Ethan may only have to have a higher bar since Asmongold watching his video won't impact it as H3H3 has over a million subs. Someone with less than 100K subs could easily go after the likes of Hasan, Asmongold and xQC as they can flood the algorithm with their video. So there can be real ripple effects, especially in regards to specific actions. The days of having your chair tag you out could be over (thank God).

As I understand it, the courts kind of look at a degree for which it was transformative and the degree to which the normal "react" video is transformative is a big issue. The problem as I see it with react content is they are playing the video from start to finish and adding in commentary here and there. There is almost no editing and a good portion of the "react" is just the video and not their commentary. Its a genre that's always been at risk of getting sued over and then having the courts determine what is transformative and what isn't. Sargon won his copyright case but Sargon also edited his videos and often he was meaningfully responding to what was being shown (and I'm not even sure these videos he did were the full video). These guys are just on a livestream, pressing play and maybe sometime adding meaningful discussion (very rarely).

Though I think the fact we agree on the latter point just shows how slop "reactions" have become. I miss when it was BABIES REACT TO TWO GIRLS ONE CUP. Simpler times.
 
Honestly though, this lawsuit thing just seems like an expensive stunt. I could see there being a case here but the yassss queen slay language talking about people being 'wasted' or 'larping' is just unprofessional. There's a time and a place and the courts is not it for being sassy.
Credit where credit is due, filing copyright on a video before uploading it to use as a honeypot was an actually smart move. It's obvious that this is not in any way about the ethics of react streaming (given Ethan's prior lawsuits essentially emboldened the genre) - his whole handwringing thing about "I'm just trying to avoid a big film studio damaging the react community" comes across as comically disingenuous. His reason for this is to get back at the audience he courted who now criticise him for being a Zionist (when he was warned about this very thing). He's also flagged that now he's filed a complaint, he has an excuse to subpoena reddit to dox the snark sub moderators.

Nevertheless I think it's essentially an open and shut case. The shitpost quality of his complaints might weaken it, but it's hard to argue that people streaming his content while specifically saying they're doing so to reduce Ethan's revenue and then also profiting off of it is hard to refute. This is going to have a huge impact and I don't like the potential implications on us being able to mirror/archive videos on the farms.

18 minutes of commentary for a near 2 hour video isn't what I'd call transformative, plus clips of them explicitly saying they're doing so to siphon money from Ethan.
