The argument for prosecuting the AI art is that it was trained on CP, which taints the image unlike "drawn" versions which I hope to God didn't use references. So, while I agree there are slippery slopes, I think there's merit to saying that AI CP is CP, and since CP is illegal so is it's derivative.

This is exactly what happens. An AI trained on naked adult women and clothed legal images of children will easily be able to infer what a naked child looks like. That is one of the main ideas behind modern image generators. The only way to stop it from happening is heavy censoring of the prompt inputs and image outputs.
