I got some questions,

Destiny has claimed that extortion might be a potential angle to attack Pxie with, how much merit is there to this?

Destiny has also claimed that he did not break any laws because the statute would not have been in effect when the vids were sent. How much bearing does this have on a civil case?

Pxie appears to have been caught in a lie (regarding never sending vids to Destiny) and has deleted some messages. Destiny has also deleted some messages (considerably more). How much bearing will this have on each of their respective sides?

1. "Pay up or I'll sue your ass into abject poverty" is not extortion

2. Even if the statutes are inapplicable, the common law torts (IIED and Invasion of Privacy) will still be there.

3. None of it makes Destiny any less liable. Maybe he could argue unclean hands or some other affirmative defense but he sat on this shit for quite a while for such a smoking gun. An honest reading of Pxie is that she would be back with the video to share. There's no implication about consent that is inferred
