There was another docket update that appears to have duplicates from document 20 but with an extra attachment.

There's still hope - part of me expects Destiny's lawyers to say the clip has additional text added to it, indicating the video has been tampered with/altered in some way. Thankfully, I still have the original VOD should anyone need it!

Very funny that clips/links from here have made it into court filings though. I look forward to them pointing out that Destiny has an account here and posts in this thread. I would also like to mention, again, that several of the thread regulars (me, Blav, Pepsi(RIP), probably others) are only here because Destiny promoted the site so much during the Keffals and Anavoir stuff.

Can someone confirm that it's actually going to trial barring a settlement or whatever, or can destiny still have it dismissed in summary judgement or whatever?
 
Random question, im not a lawfag but this means the case will not be "tossed" or "dismissed" or that can still happen?
Because Destiny said that will happen in a log just the other day

Destiny is a colossal retard with no self-awareness. Seriously, how many times does life have to kick your ass for the stupid, immature shit you pull before you decide "I've had enough"? Does a Grindr encounter have to go sideways, and have you meet up with some thug who pulls out a knife and stabs you, leaving you for dead on the streets before you barely manage to wake up the next morning before you think to yourself "hmm, maybe I should change the way I live". He's had his credibility absolutely torn to shreds because of some fucked-up shit he himself did, yet instead of taking at least a little bit of accountability, he wants to get mad at the BPD girl for rightfully saying he should be punished for being a weird sexpest. He's not sorry for what he did at all, and I honestly wouldn't be surprised if the shit with the Pixie girl was just the tip of the iceberg with this Cuban dwarf.

I think there are some lolcows that actually have a decent chance at redemption, but Destiny is so far gone that he will never see the light. He's legitimately at a point where his underage son is exposed to videos of his own fucking father deepthroating dick, and all he can think to do is use this fact to garner brownie points for a completely unrelated internet drama. Seriously, what the fuck? I feel like that's some shit that would make some veteran lolcows wake up and smell the coffee.

Wonder what they would think about his deleting spree.... luckily there are plenty of archives of everything that was leaked, meaning that both the original messages AND the fact that tiny went ahead deleting everything are plain to see.

Destiny will ask for evidence to support his affirmative defense claims.
The big one will be "Failure to state a claim"

If she can't show an instance of him sharing one of her videos after October 2022, he will most likely file a motion to dismiss with prejudice after or maybe even during the discovery phase. I think it is very likely that Destiny shared it after, but maybe he will not disclose it during discovery hoping he can get away with it. The "person said her sister got a Pxie video from destiny" won't be good enough. At the very least she will need an affidavit.

Thinking about it. He said he thinks it will go to summary judgement and get tossed. That probably means he will disclose that he has shared a Video of Pxie after October 2022. That means that affirmative defense will only be used to show that Pxie lied in the original complaint.

Destiny is not a lawyer. When he said this he was talking out of his ass. He doesn't know what a "summary judgment" is. There's not going to be a summary judgement here, it's unlikely either parties will request it. His lawyer will probably try to deny and oppose as much as possible.

Interesting that this is filed now. There was some discussion as to why Pxie lawyers didn't file this. Also interesting thing about this section is it confirms that settlement discussions occurred.

If you see him say this again, can you clip it and post it here? I don't watch his streams because I don't find them interesting. However it is interesting to see his state of mind regarding the lawsuit. He is a good liar so I probably won't be able to tell if he is saying it for the benefit of his audience or if he actually believes it too.
