Crime Malaysian transgender entrepreneur, charged in her country for dressing like a woman, arrested in Thailand


A transgender Malaysian businesswoman charged in her country for dressing like a woman has been arrested in Thailand, police said Monday.
Nur Sajat is a well-known cosmetics entrepreneur who fled her homeland after she was charged in January for cross-dressing.

The 36-year-old was charged in an Islamic court outside Kuala Lumpur for bringing contempt to Islam by dressing in feminine clothing when attending a religious event in 2018. She faces three years in jail if convicted.
In February, the court issued an arrest warrant after Sajat failed to appear at a hearing. She has been on the run ever since.


Sajat has reportedly received death threats after suggesting in a now-deleted social media video that she was contemplating whether she should renounce Islam, according to The Associated Press.

On Monday, Malaysian police confirmed Sajat’s arrest.
In a statement, authorities said that she was detained on Sept. 8 for having an invalid passport. She was charged with immigration offenses, then released on bail.

Police said that Sajat is wanted in Malaysia for other offenses, including criminal intimidation and obstructing authorities in carrying out their duties.

“Efforts are being made to bring the suspect back,” said police official Abdul Jalil Hassan, the Agence France-Press reported.
Human Rights Watch Deputy Asia Director Phil Roberston urged authorities not to deport Sajat, who’s seeking refuge with the UN Refugee Agency (UNCHR).
“As a @UNHCRAsia recognized refugee, under no circumstances should Nur Sajat be sent back to #Malaysia,” he wrote on Twitter. “She needs to be sent to a country that will offer rights protections, not persecuted for being #LGBT which is what will happen if she is sent to Malaysia.”
Local media reported that she plans to seek refuge in Australia.

Constitutionally (in Article 160 of the Constitution of Malaysia), one of the four tests for entitlement to the privileges accorded to a Malaysian Malay is that one must be a Muslim. The rationale for this is that Islam is considered intrinsic to Malay ethnic identity, which culturally and historically is ruled by a Sultan who is a Muslim. Another test is that one must follow the Malay culture. Controversially, court rulings have assumed that all ethnic Malays must automatically satisfy this constitutional definition of a Malaysian Malay, and have therefore concluded that they must satisfy all of its requirements, so they have to be Muslim.
