Yes. First, he's already filed a 59(e) motion that would be pending, and therefore, it is premature to file an amended complaint in a lawsuit that is dismissed with prejudice and without leave to amend. Those actions are contradictory, because the 59(e) motion would be about the ruling on the amended complaint, the operative pleading. If the court accepted an amended complaint, that would become the operative pleading and the 59(e) motion would be moot.

So this asshole is just wasting everyone's time with his frivolous, incompetent stupidity.

And, again, it is usually only granted if some new material information became available that changes everything, or an appellate/Supreme Court issues a new ruling that would have changed how the court should have handled this case. Practically yes, theoretically no. The court court grant his motion to reconsider, reopen the case, and accept his amended pleading. That being said, such motions getting granted are extremely rare, and chances for this to happen to Russ is practically non-existant.

Yes, actually. Entirely this. His one hundred and fifty-seven uses of “the court overlooked” is his pseudo-polite way of angrily seething, “the fucking court didn’t READ WHAT I WROTE!! If they read it, they’d understand!!!” If they read it again and still don’t agree with him, they didn’t read it well enough. Russ believes everything he claims in life is 2+2 and anyone who can’t see that is just being willfully stubborn, ignorant, or secretly malicious.
