I see the judge is pointing out that Russell would have had a better case if he simply sued under DMCA.

But, you know, it is way harder to harp on emotional feelings in a dull, dry copyright case.
And the fact that, you know, you can just send Null a DMCA takedown request - as is proper form.

It's funny how there's a common theme among vexatious litigants that they never sue based on hard evidence. It's always "they did something that hurt my feelings". How do they go about maintaining a superiority complex over everyone else when their emotions are so fragile?

AGT saved Russell's ass a lot of trouble here. If they would have chose him to be on the program, he'd have been voted off first round and millions of people would have laughed at him. Simon Cowell would have made fun of him. He'd probably sue regardless. His narcissistic ego makes him incapable of learning from any past mistakes. I just can't wait to see where this lolsuit goes and who he decides to sue next. I'm hoping for a suit against the federal government.

Also, he certainly is exceptional to create an act that was designed to appeal to one judge in particular. That isn't showcasing talent, it's just pandering and cringy. A good way to get voted off regardless.

That is his talent: pandering to specific female celebrities to get fame and fortune. Or, at least, it's all he knows how to do.
 
What gets me about this angle is why he didn't just submit his audition as a group act (something that's already allowed anyways).

And I understand that 'talent' is a broad spectrum, but AGT is a performative talent show. Being able to write good (in Russell's mind) music isn't something people would pay/tune-in to watch. So once again, why not do a group act? You can be the composer/keyboardist and let your band mates do the rest. Now you can use your talents in a way that actually fits the format!

Of course, I know the answer: Russ's ego won't let him share the spotlight.
This is a man who credits the singers of his songs as features. He only cares about himself, the idea that he could be a part of something successful is foreign to him, he wants it to be all about how amazing he is, he doesn't want people to say "hey, this pretty good band has a disabled guy in it," but rather "this disabled guy is so talented, those other musicians are so lucky he even so much as spits in their general direction."

Eliminates fun for us. If they would just start making him actually pay to harass people with lawsuits instead of doing it at the cost of the taxpayer that would be a good start.
I don't have any choice. He's filing an appeal. I'm going to go for damages.
Peace was never an option. I wonder what post-judgement discovery will look like...
