Yeah if you help someone write a legal brief and you're not a lawyer KEEP YOUR DAMN TRAP SHUT! It's not illegal but goddamn you aren't helping them. At all. I've written legal briefs as a pro se so I understand what needs to happen and what goes on. I was lucky in that I was able to ask actual lawyers how to format things and what cases to include but i did the writing myself. It's entirely possible to crib from others without being exceptional like this. Keep your comments about the help you give others in PRIVATE. Not on goddamn Kiwi Farms. Ffs I can't even.

After whining to the court about how Vikki was evading service at a 2 million dollar property in Castro Valley, Preston has reportedly located, and served her nearly 400 miles away in an apartment in Huntington Beach on October 14th. There's no explanation or apology for that unfounded allegation.

And because this is Preston, the summon lists her as Victoria Kunder. :story:

Regarding the service to Vikki, Poulter’s attorneys have screwed up. The Federal Rules require service within 90 days of the filing of the Complaint. This Complaint was filed June 3. We are way past the 90 day deadline. In the words of the applicable rule, “the court . . . must dismiss the action without prejudice against that defendant” Vikki could get this case dismissed against her by pointing this out.

Also, I agree that @VIkkiVerse should file her MtD (to avoid a potential default judgment) and mention that the 90-day expiration date has passed (along with the usual jurisdiction issues that @FROG's lawyer, Scott Houtteman, brought up).

This a rhetorical question, yes?

From what I have been told, Poulter relayed in his discord that his process server claimed that the woman who answered the door refused to accept service, was told she had to, and the summons was left outside her door.

It is not an uncommon occurrence for people who are not named in a summons and have no knowledge of the person being served, to refuse to accept service.

If I didn't live hundreds of miles away, I'd consider heading on over and offering her an explanation.

My sides are in orbit. Why on earth do these process servers always swear they got the person when they have no proof the person is who they think they are?

Sure but he would just refile. Not really useful unless dragging this out is the goal. Much like with Greer and Melinda's suits against Null, Null could have gotten them both bounced for lacking jurisdiction. But it would have just been dismissal without prejudice. The tards would have just come back. Better to just engage with the case on its merits (of which there none) and dispose of it WITH prejudice.

This is true. Because now if the court believes the server, Vikki will still have to enter into the case to say that she wasn't served properly because "wrong address" when the court grants Preston his stupid default based on this service. That's why the process server is infuriating for not getting confirmation of who it was they served.

Fair enough 😆. Also, I saw the Ro parts, but wasn't 100% sure if it was his actual account or not. I was never really sold on the Ro/Peggy(War Cucking) alliance and thought if it was real, it was more of the "enemy of my enemy" type thing. This makes it look more like an actual friendship between the 2 or Ro is truly unashamedly desperate for people in his corner.
