Yes and he was able to identify evidence images of things on fire just now so idk what he was trying to play at there.
 
Both prosecution and defense keep referring to both sides of the... uh... conflict (?) as if they were military forces. Like they're saying "stationed" when there's a gathering of people.

Which the defense should counter, hopefully. A sling can be lifted from someone's shoulders even if it would be awkward. If it's some kind of QD sling, you can just press a button and undo it. Again, awkward, but still doable.

And even if the sling stays attached, a larger stronger person could still wrench it out of someone's hands. Manlet height aside, Pedobaum was still a 150 pounds fully grown man, and on a 5'3'' person that makes a pretty beefy dude. He could still pin the gun and beat a teenager to death.

They don't need to make any fancy arguments, really. Just keep pounding the fact that people were trying to kill or grievously injure Kyle.

People get scared of movie monsters. People get scared of thunder. Sometimes I wish that at any point in time that someone makes this argument, we could slap a bullet proof vest on the lawyer and point a gun at their chest and if there's even the slightest spike in heart rate they have to redact their argument.
 
minimize the dangers of the night, show that the police did have control, that other guys with guns were pretty safe.

They have to show that kyle was looking for conflict, pursuing conflict.
If his "friend" couldn't incriminate him in any dialogue had prior to the incident, the prosecution is done for. There's nothing they have on him that shows he was looking for conflict. Even so, it could still fail to prove guilt. If he was "pursuing conflict," he would have fired off more rounds and hit more people than were hit that night. Less than 10 shots from (what I assume is) a 30 round magazine? An interesting amount of restraint from some one they're trying to claim was an attacker.
