Reading these replies is so depressing. These people don’t know a single thing about the case, and are proud of their ignorance. It’s not even a subject of debate in court, saying he “kneels down and fires into the crowd” is just a bald faced lie. They read the lying press headlines, and the lie is ingrained in their brain. “Kyle was a mass shooter.” They refuse to watch the video that blatantly shows the opposite, because in their world, they already know the absolute truth and nothing can change their mind. Here’s a thought experiment: will this actual, by definition FAKE NEWS get a little fact-check disclaimer on twitter? This is why journalists get the rope first, in minecraft.

Except doesn't DV fall under Lautenberg? I don't think there's any real way to get 2A rights back from any DV conviction, even after being expunged; in that the .gov says it's technically possible, but actually it's not going to happen. I've heard of people filing motions to offices that don't even have any staff, etc.

And if it happened with the antifa medic, pretty much that means someone pulled strings for him that aren't available to normal citizens.
Lautenberg is what placed the misdemeanor dv disability into law, but the way out is similar. It's going to be slightly different in every state and probably impossible in some.

All I can really say for sure is that the Missouri expungement statute is effective at restoring rights in both cases, and we explicitly designed it that way. Had clients pass a NICS check and everything. There isn't even some seperate office you have to write in to or anything. It's just going to be super different in every state.

The relevant statute for the DV expungement part is 18 U.S.C. 921(a)(33)(B)(ii), what fucks people is a lot of places will only seal the record, which isn't enough. It has to be expunged or set aside.

There's some statute where you can Petition ether the attorney general or the secretary of state of the United States (I forget which) to remove your firearms disability, but that's basically fake. That's probably what you're hearing about.

Can someone help me understand the legality or non legality of the firearm that Kyle Rittenhouse possessed.

My understanding currently, is that Kyle gave his buddy money to purchase the rifle, "for him". However, possession of the rifle was never transferred to him, as his friend had it at all times and only gave it to Kyle when they went shooting and when he went to Kenosha (never crossed state lines). I understand he's (the friend, not Kyle) on trial for what's essentially, a straw purchase leading to death.

So far, this trial is a slam dunk for the defense. Kyle approaching the police, then being pepper sprayed and reprimenaded, along with multiple police officers giving testimony that Kenosha was essentially a warzone, and Kyle saying he's going to get the police after the shooting of Hubert..how can you convict him?
Holding a firearm in trust for a minor is legal, and theoretically what he testified to in court shouldn't be a straw purchas - but good luck.

The supreme court case a few years back on the blue lable special glock really fucked up the law on that though. The ATF interpretation of the law and the statutory language aren't really comparable. The language of the statute seems to suggest that straw purchases are actually ok as long as the guy it's for isn't a felon/incompetent but that's not how the ATF treats it.

Chevron v. NRDC will probably not be good law by the end of the year though, and that will change even more gun shit than the pending NYC case will.

George Floyd’s nephew, Cortez Rice states he knows people taking photos of the jurors during the Rittenhouse trial with the goal to dox them if they do not convict. Regardless if the claim is true or not, Rice/BLM is attempting to tamper with the jury.

I certainly hope so. To those who don't know, Chevron is a case that is the embodiment of what is called judicial deference, specifically deference to the decisions of administrative agencies in interpreting the statutes they are tasked with enforcing or carrying out.

The general principle is that unless the interpretation is palpably batshit insane, they can almost just make up the law as they go along, which is certainly what the BATF has been doing for decades. Clarence Thomas, among other Justices currently on the Court, has been skeptical of this concept for decades, all but calling it unconstitutional.

From when he got on the Court about 30 years ago, he's been a voice crying in the wilderness on the subject, but with the changing composition of the Court, he may very well be in the majority now.

I'm not convinced the doctrine is going away entirely any time soon, but it's certainly in need of a revision, and the deference accorded to administrative agencies should not be anywhere close to absolute, as it nearly is now.

In any event, the BATF would certainly be among the agencies that got their flight feathers trimmed a bit by such a decision.
 
I cannot imagine the thought process of anyone that has watched the video footage and still believes Kyle is guilty of anything. These people are not human, they have been so broken by the media circus that they would defend a child rapist, a wifebeater, and a violent criminal trying to kill a kid, simply because their politics are right and Kyle's aren't. They have been programmed to the extent that they will literally refuse to believe their own eyes over the official narrative. If the media told people the sky wasn't blue, they would ask you for a source when you pointed up.

This was how I felt about Jan 6. Lots of cases. Lots of people are just misinformed and will never be informed, on purpose. They have a better dedication to having their outrage addiction quenched rather than the truth. That reddit thread posted earlier is a good sign of that. Either they don't know what he was actually saying or communists think yelling if anyone needs medical or 'Friendly! Not seen this one, but earlier, they have mentioned that it's got a shot at succeeding, but is a very rare thing and is always highly unlikely.

I listened to the NYT podcast about it where the female jewish journalist ("Integrity? What's that?"). She lies throughout, shocker. But she also claims that Rittenhouse shot Rosenbaum because someone else in the crowd fired a "warning shot." I've seen this repeated on reddit, too. She uses this to bury the fact that Rosenbaum was going for Rittenhouse's gun. She also makes sure to describe Rittenhouse as "aggressively offering medical aid." It's such a hit job and full of bullshit. I'm sure people who don't want to think too hard just slurp up what the journos say.

"DO YOU NEED MEDICAL ATTENTION MAGGOT! ANSWER ME! RAHHHHHHHHHHHHH" - witness testimony before BLM mob enacted a citizen's arrest on Rittenhouse due to aggression.

It also cracks me up to see these people go, "Rittenhouse shouldn't have gone there or brought an illegal gun." Ok, then Fentanyl Floyd shouldn't have used a fake $20 if he had drugs on him. And Jacob Blake shouldn't have tried to kidnap kids and go for a knife. Funny, these things only get suggested when the perp is white.

Edit: Actually the situations with Floyd and Blake have nothing to do with Rittenhouse's situation, because self defense is still legal, and he was in a public space. WI doesn't have a duty to retreat (although he did attempt retreat). Open carry's legal. The only issue is the gun may not be 100% legal.

I was hoping for "embodiment of utter corruption and cuntyness" but then looked into the cited case, and realised I was getting NRDC mixed up with the current Dozinger travesty of justice.

Not sure if there's a thread about that floating around here, my search didn't bring back any hits... Any info/opinion etc you have on that would be interesting...
