Been thinking about this. Defense should not simply ask Grosswigger about wanting kyle dead after the fact because he can just deny it. Defense needs to call the friend who made the post and ask him about it.

pre judgement prediction: guilty on all charges.
"Guys make sure you vote guilty or we will riot, but if you vote innocent it'll embolden people to defend themselves vs rioters, so vote guilty so when we DO riot, we can do so without consequences"

Yeah this isn't exactly the same as George Floyd where there's a mortal threat behind voting for innocence.

Yes, it is generally within the judge's power to dismiss a case upon a motion by the defense at the end of the state's case. The judge, after hearing all the evidence, can find that the state didn't meet its burden of proof. Any competent defense attorney will make such a motion in just about every criminal trial. Usually it gets denied because the state usually puts on at least a prima facie case (that is, there is enough evidence to meet the elements of the crime charged).

In this case, though... I think the judge will be sorely tempted. Seems to me that the state has brought out a lot of evidence that is 100% consistent with self-defense. Still, I would expect he will allow the case to go to the jury - that way he avoids any politically-motivated accusations and will let the jury make what should be an obvious decision.
