It depends on how the charges are dismissed. If they were dismissed with prejudice the State wouldn't be able to refile them. Just to make clear, a Not Guilty verdict is not the same as a verdict of Innocent, fyi. You really aren't found innocent in a criminal trial in the US, just that the state was unable to convict you of a crime beyond a reasonable doubt.
