Just putting this here to remind people not to approach somebody who has a gun pointed directly at you. Anyways Day 6 is here, let's see how bad the shitshow gets.

So if the poll the jury on a deadlock and it comes to a few guilty votes out of 12 does the state retry the case?

Their has to be a cut off where if the number thinks Kyle is guilty is below a certain threshold then continuing charges becomes a waste of money.
If the trial is hung then the prosecution really doesn't want to retry it, but might try anyway. It'd be a disaster though, given that this trial established a ton to help Kyle with a laser focus, as well as depriving the prosecution of its evidence fuckery, Not to mention resulting in a more hostile judge.

Which, to be fair, would be a perfectly reasonable way to go. Unfortunately we live in clown world, and I’m sure there are powerful people that want an example to be made. Forgive me if I have little faith in anything in this country after all the shit from the last 2 years.
Its a misdemeanor charge only, so it's be the smallest sting possible. I'd appeal after, too, and get the gun charge overturned for vagueness as well. Hopefully the jury has had enough of Binger's bullshit and just go Not Guilty on everything as a middle finger to the prosecution.

I still think that's BS. My read says long guns are exempt if over 16.
It's not a thing for the judge to decide but could be appealed. It's what the judge was referring to when he said it seemed like it should be void for vagueness, but it's not his place to decide that.

Really good appeal grounds though.

Edit: ninja'd by @JohnDoe

I swear the prosecution thinks everyone is terminally exceptional so they go over things like they're a Nintendo game's tutorial, when in reality they're the biggest retards for thinking this approach would work.

They are painful to watch.
To be entirely fair, jury members are by definition terminally exceptional - anyone with any brain cells can easily avoid jury duty so the only people left are the kind of people who need this sort of mental handholding.

Sadly the people who would acquit Kyle would traditionally be law and order types that would convict on the gun charge IMO.

It's ridiculous how much evidence the prosecution has just hidden or waited until the very last minute to order produced. How the fuck do you have a year to prepare for trial and not think until a week into the trial to send drone footage to the lab? It has to be done to prevent the defense to hear about it right?
Done to delay as much as possible the defence's ability to utilize and examine it, yes. And is part of why a mistrial would be so god damned bad for the prosecution.

They're going to argue that Kyle should have tried to TF2 medic rosenbaum to life again.
