Not in an of itself, but it opened up jury instructions to provocation, namely, that if you provoke an attack you no longer have a right to self defense.

The actual blob in question is too hard to argue beyond a reasonable doubt, but now jurors who were looking for a way to bury Kyle now have "provocation" in their head, and now have a reason to project their "he crossed state lines to threaten people with a gun!" insanity onto Kyle.

TBH I’m not sure how the defense would refute this, because it would just further bury it deeper into the minds of the jury. Doubt has been created about his purity of intent, and that…that might not sink him on its own but it will not help him.

I'm not as blackpilled as the others here. I find it virtually impossible that 12 jurors will unanimously agree to provocation, and thus a murder conviction. Remember, Kyle still has presumption of innocence that he didn't threaten anyone, and virtually all testimony and video footage show Kyle being at best indifferent, and often times offering medical aid. And that blob photo is so retarded that all it takes is one nearsighted juror to say "yo I can't see shit" to put reasonable doubt.

The curfew charge was thrown out, so a karen can't screech that Kyle was wandering around unmasked after hours and making people aggressive. There's also a good chance that the weapon possession charge might get bounced and/or there are jury instructions that clearly outline why Kyle was an exception. With that gone, they can't reasonably say that Kyle was provoking aggression by wandering around with an AR.

There's plenty of evidence that Kyle wasn't provoking anyone. The question just shouldn't be there in the first place.

Defense should've brought up Kyle's therapy for PTSD as a credibility booster when Kyle was on the stand in case there was some tards thinking IT WAS FAKE like the media pushed the moment he broke down on the stand.

If he had a more competent prosecutorial team (all good ones said "fuck that" due to the evidence being so overwhelming) or if the case was vague due to lack of evidence or legal grey area, he'd be gigafucked.

I find Chirafisi 1000% more compelling than Richards. But I have no idea how big of an impact the whole "Richards talks like a parody of a Kenosha resident" has. If the whole argument that the prosecutor has is "Kyle CROSSED STATE LINES" to "attack OUR GUMMUNITY" - maybe it really is better for the jury.
