Judge declaring mistrial with prejudice is only going to happen is if he thinks that will reflect less poorly on him than a successful appeal with prejudice at this point.

This dude has been a judge for 40 years and has locked up people he was pretty sure was innocent at least a few times.

If he thinks appeal with prejudice looks less bad on him he will let it slide even if he knows its a miscarriage of justice cause Kyle will get out on appeal right? No biggie to him if he rots for a couple of years. Justice will win in the end is how i would bet this judge thinks.

Now one option nobody is really talking about is a good ole mistrial (without prejudice). Especially if binger convinces him the state will totally drop it due to not wanting shit show.

Everything this judge does makes sense when you realize law is his religion and he views himself as a cleric/priest of that religion as a judge. He will be and is mad at Binger for blasphemy towards it just like a priest would be. But the odds of him actually doing anything about it is the same as your catholic priest denying confession or eucharist to a sinner.
 
Defense is offering a 'compromise', Mistrial without prejudice. Which is good by my book, since I have pointed out multiple times that the Defense can't pull this shit twice.
