My old man talked to me about this case on a call the day after the judge yelled at Binger for trying to pull off the 5th amendment play. I went "oh, this judge is pretty good on making things run smooth". "No he isn't, he's too soft, just watch this trial play out, he will show himself to be too soft in the coming days" said my old man.

Turns out his read was correct. The amount of dirty tactics and testimony to things such as witness tampering attempts and failing to give the defence all evidence and so on, and the judge just going "but I want to see things through" makes him way too soft and influenced by the politics surrounding the case and wanting there to be "proper closure" rather than doing what should be done in respect of all this prosecutorial misconduct.

The defence knows the judge probably doesn't want to declare a mistrial with prejudice, and that the state probably won't bring the case up again if a mistrial is declared. The defence believes that a mistrial without prejudice is easier to obtain and still means Kyle gets to walk.

That's a hell of a chance to take with kyle's life.
