Defense are cowards now. Why would they want to go with this all over again when the prosecutors will just do the same slimy tricks as the first time? A mistrial only benefits the Bingers.

For one, they knew the judge had already made it clear they weren't getting mistrial with prejudice, so they tried without prejudice. There's also the fact that the DA might drop it considering this trial has made their office look like the Ringling Bros Circus.

It's supremely simple, the prosecution is responsible for their own evidence. They are supposed to share it and they screwed up and/or maliciously altered it to give themselves better positioning.

The judge absolutely refuses to give the prosecution the L. Yes, he obviously wants the jury to provide legitimacy to things, but it's going out of the way to screw over.

Is the judge waiting for the verdict first? If not guility, letting it ride, but if guilty then declaring a mistrial? That's the only legit path I see here barring the judge being scared of media scrutiny.

That does appear to be the case. As irritating as it is watching in real time, nothing has actually changed between the submission of the motion and now. He hasn't outright stated "Kyle Rittenhouse will walk out of here a free man, one way or the other", but the threats he has made indicate that is where he is headed.

It's often difficult to tell the difference between patience and cucking in the heat of the moment, we'll have to wait until the whole picture is clear.

They want the mistrial. The defense is literally giving them what they want, a chance to regroup and come at the case from a different angle.

Yeah but he can still do that. A couple hours ago he said he's still considering it. A minute ago he winked at the defence about waiting for the jury first, and a bit before that he was talking about needing the prosecution to make these statements under oath.

If what someone said ITT a few pages back is true, a mistrial with prejudice can be appealed if it's applied at this stage of proceedings. An acquittal can't. It seems like he's aiming to do the best thing for Kyle here, but I also wouldn't be surprised if he goes after a boy and his blob hardcore after the jury comes back.
