My hypothesis is that the defense team sort of gave up on actually winning at trial. Schroeder is a very pro-prosecution judge, so that isn't a completely unwarranted strategy. It looks to me like they were trying to set things up for an appeal. They just assumed they would lose any motions to dismiss, etc., and then use those as the grounds for an appeal.

The problem is that the prosecution did a piss-poor job of actually prosecuting the case, including a serious Brady violation. The defense wasn't ready for the prosecution to be so incompetent. They have not been nimble enough to realize that they have a solid chance to win at the trial level and pivot to winning at trial instead just making a record for an appellate reversal.

I think they still have a chance to pivot to winning at trial if they are willing to do it. An aggressive motion to dismiss based on Fatlock's lies filed tonight will go a long way. Even if Schroeder is pro-prosecution, those kind of judges don't like sloppy and incompetent prosecutions. If the defense gets its shit together RIGHT NOW and puts together a solid motion that points to specific misconduct by the prosecution and how it specifically prejudiced the defense and links that misconduct to the shitshow the trial has become they have a good chance of success.

They need to put down their Rhinelanders and cheese curds and fucking write the motion RIGHT NOW and get it filed by midnight.

When being conservative meant they could take away freedoms and torture people and get support, that's what they did. When W fell out of favor, they switched to appealing to the progressives so they could ban books and shoot citizens while looking like the good guys. As the conservatives dig in their heels to resist the authoritarianism, those elements push into liberalism and encourage political polarization all the more, but it's not because they actually believe in leftist ideals, it's because it's the side most likely to allow them to gain more power and strip more freedoms.

The US is a unique example that has a myriad of individual state governments, police districts and various levels of judicial reach per state that it makes collating into a single system all the more harder, it would also give legitimacy in opposing anything the federal government does on a state level.
Other countries that use the Westminster system of Democracy are put into strata so that local state governments follow what those in power command, they leave local state matters to state govs but expect them to comply with federal demands. In China for example you wouldn't see a local state gov push back against a directive from the party, they'd find ways to work around it.
