If its 10-2 to acquit the chances should be low for DA to re bring the charges. If they do re try they would get slapped even harder.
Even if he is acquitted, I'm sure the Biden Regime will just bring him up on federal charges. ANTIFA/BLM are the regime's shock troopers. Can't let you little people harm a single hair on their heads. Know your place. In your pod eating bugs.
 
It really depends how much political will the DA has.

Even if they don't win, the process is a punishment all itself.
It's also why his legal defense fund is one of the few worthy ones. Although next time he better get additional/replacement counsel because these guys are fucking way too passive.
 
According to @Gehenna the DA implied pretty strongly that he didn't want to prosecute but Binger went forward with it anyway. Whether or not the DA (or Binger) will want to do it a second time, or whether or not the can hold Binger back... well, that's a bit up in the air.
If you read the original complaint, it was clear nobody in that office wanted to bring it. From that document alone I'm speculating the plan might have been to use the Grand Jury to drop the case.

When a DA doesn't want to bring a case to trial but wants to act like they gave it a go they will take it to the Grand Jury, which is secret and out of the public eye. Away from the media they then totally botch it on purpose so the GJ fails to bring any charges. Later, when reporters ask it's "we just didn't have enough to sustain charges under the law, we totally tried super hard, trust me bro" which sidesteps the baggage of declining to charge. After all, you can indict a ham sandwich so it's just as easy to make sure the charges don't stick.

Binger being Binger, though, he decided to fraud his way to trial.
 
Hmm, if I was on the jury I would wait until the sun sets on Friday to give out a not guilty verdict. It would be perfect for a riot.

It’s dark. It’s the weekend. Christmas is next month and every needs some extra loot to put under the tree.
