The latter, unnecessary to lock it because a Not Guilty Verdict would institute double jeopardy as a thing so they can get fucked. Granting the motion gives Richards and Agent 47 standing though to nail Binger and Kraus to the wall for prosecutorial misconduct.
 
Libs are screeching that federal charges be brought, which would not count as double jeopardy (multiple sovereignties doctrine). But I don't think that's likely to happen.
At this point the only grounds prosecution could stand on are some ambiguous bullshit about muh racism and threatening the jurors with violence if they don't convict.
 
If you've got money to burn, yes. Can be a costly affair and it's unlikely to go anywhere, but people will do it anyways.

The prosecution absolutely CANNOT appeal an acquittal on criminal charges in the US.

If evidence brought up new charges that might be one thing, but Kyle CANNOT be re-prosecuted in any way.

This isn't a court system like in the inferior shithole of Italy.

VERO BEACH – A Gifford man who claimed he was defending himself and his girlfriend when he fired shots at deputies during an early-morning raid in 2017 was acquitted Friday of charges that carried a life prison term.

A jury found Andrew “A.J.” Coffee IV, 27, not guilty of second-degree felony murder, three counts of attempted first-degree murder of a law enforcement officer by discharging a firearm and one count of shooting or throwing a deadly missile.

The charges related to a March 19, 2017, fire fight between a Sheriff’s Office Special Weapons and Tactical team and Coffee IV at his home in the 4500 block of 35th Avenue, Gifford.

His girlfriend, Alteria Woods, 21, died during the raid after being struck by 10 bullets fired by a SWAT team member, including one shot that entered her chest, records show.

This very melanated individual was catching a murder charge because he got no-knock SWATted, thought his place was being broken into and started firing back, and in the process the SWAT team Swiss cheesed his girlfriend.

Legally, and officially, its a mistrial... somehow. He explicitly said he is granting the defense's motion. But it's also an acquittal since that is the point the prosecution loses its right to appeal a mistrial.
So, he got the verdict for the sense of justice, called the mistrial because by every right it was, and now he's gearing up to assfuck Binger for being a piece of shit? Holy shit, the old man was good as his word, the DAY OF RECKONING is upon the prosecution.

Specifically, what -can- be appealed is a Mistrial w/ Prejudice ruling which is what was being referred to in the line of comments, but it -cannot- be if done right after a Not Guilty verdict.

If the Biden DOJ really wanted to tear up the rule of law they could transfer him to a DC district court. There's literally no legal basis to do so, but there's no basis to federally charge him anyways.

I feel bad for the kid. He's not guilty but the legacy media has trashed him; his life has been threatened regardless. Hope is the kid going to move on in life? He won't get that chance. I hope the best for him; he defended himself.
Anyone who would hate Kyle or treat him poorly because of this isn't worth his time anyway. Chauvin had a good amount of support, but it's nothing compared to this. Beyond the MSM and extremely deluded/ignorant leftists and BLM rioters, the public's been overwhelmingly supportive of Kyle.
