NYC vaccine mandate extended to children 5-11 years old

Children ages 5 to 11 will need to show proof of vaccination to dine out, see movies and enter fitness facilities in New York City starting Tuesday.

New provisions to the city's vaccine mandate have been expanded to children who previously were allowed to accompany vaccinated adults.

The requirements will also apply to many after-school activities for children, including band, sports, orchestra, and dance at public schools -- a policy that previously applied to those aged 12 and older.

Mayor Bill de Blasio launched the "Key to NYC" vaccine mandate for adults in August.

Up until this month, partially vaccinated New Yorkers ages 12 and older have been allowed to enter indoor venues. But later this month, they will need to be fully vaccinated to enter restaurants and movie theaters in all five boroughs.

The mandate will begin Dec. 27, the same day de Blasio's private-sector worker vaccine requirement takes place, and four days before he leaves office.

More details on the private sector vaccine mandate are supposed to be issued Wednesday.

Protests have emerged against New York's vaccine mandates, and many have lost their jobs as a result of noncompliance.

Marciano v. De Blasio -- NYPD Blues --

Remember the NYC police detective who sued for an injunction within hours of de Blasio's new November "zero tolerance" mandate for government employees (no testing option, no religious exemption, medical only)? Today was the deadline and the judge granted the injunction... possibly only for this one detective. (Archive) WTF?

In a hearing Tuesday, State Supreme Court Justice Frank Nervo granted a temporary restraining order requested by Detective Anthony Marciano, who sued Mayor Bill de Blasio on Dec. 1 on behalf of himself and all others “similarly situated.”

But the parties disagree on whether the decision applies to anyone other than Marciano and, when asked in court by a lawyer representing the city, the judge declined to say. Nervo didn’t issue a written order and said “the court declines to define it any further.”

Really wish either a recording of the proceedings or the actual order was published so I could read it.

In the hearing, Finn argued that Marciano, who has already had Covid-19 and recovered, shouldn’t be forced to take a vaccine he doesn’t want that he believes may harm him. She argued the mandate violates his right to informed consent and that the city’s Health Department lacked the authority to issue the vaccine requirement.

That probably has something to do with it, this particular cop is something of an edge case. Leaves the door open for the govt to argue employees with no vaccination and no recovery from a prior case of covid are not "similarly situated" (this is a "magic phrase" in litigation with very specific meaning) and thus they can still force those cops to get vaccinated or get fired. This is destined to go right back into the court system. Very efficient use of taxpayer money and court time, Justice Nervo.

“Unlike every other court that has considered the question, a single judge appears to have issued a TRO prohibiting the City from putting a single police officer who refuses to be vaccinated on leave without pay,” the Law Department said in a statement after the hearing. “If we get a written order, we will immediately appeal. The City’s vaccine mandate is lawful and a proper exercise of the Health Commissioner’s authority.”

The other bit of action for NYC is the NYC teachers' lawsuit against their mandate that was just raised from the dead a few days ago. Apparently they were spawn camped by a judge, as their suit is now dead again -- the judge declined to issue an injunction blocking the requirement. (Archive)

U.S. District Judge Valerie Caproni on Tuesday ruled against two groups of school employees seeking to halt enforcement of the requirement against them on religious grounds. Caproni in October ruled against a claim that the vaccine mandate is unconstitutional on its face. The federal appeals court in Manhattan also ruled against the employees’ constitutional claim.

IL has joined the game with a class action lawsuit by 88 IL schoolteachers spanning 22 school districts. (Archive)

The lawsuit naming 22 different school districts, the Illinois Department of Public Health, the Illinois State Board of Education and the governor as defendants seeks an emergency injunction blocking Pritzker’s health requirements for school personnel.

The challenge in Sangamon County Circuit Court argues the vaccination and testing program violates the state’s Health Care Right of Conscience Act.

“The educators object to the vaccination and testing of the coronavirus as both health care services violate their moral conscience,” the lawsuit states. “Should the educators object to these proposed health care services, the law prohibits the defendants from discriminating against them.”

This one has a new wrinkle compared to other state cases -- IL has its own statue regarding religious and moral exemptions, born as a part of the late 90s flurry of state laws designed to allow health care providers and employers to opt out of providing/covering birth control or abortions based on religious objections, but which were useful outside of that narrow area. This one isn't a bare 1st Amendment/Title VII claim. The 1998 Right of Conscience Act already had a bullseye on it because of covid, and on November 8th it was amended to carve out an exception for Le Coeuf.

Illinois’ Health Care Right of Conscience Act grants Illinoisans the right to refuse to participate in health care that is against their convictions, but Gov. J.B. Pritzker wants to change the law now that public workers are using it as a basis to challenge forced COVID-19 vaccinations.

“The Health Care Right of Conscience Act was never intended to allow people to avoid public health guidance during a global pandemic. The administration supports efforts to clarify the law, so it cannot be misinterpreted by fringe elements,” said Emily Bittner, Pritzker’s deputy chief of staff.

The Chicago Police union chief said the health care conscience law is designed to protect exactly those who are now seeking its protection from forced vaccination.

“I mean, it literally says if you have a firmly held religious belief, a firmly held conscientious belief, against a medical procedure, you are covered by that statute. Period,” said Chicago FOP president John Catanzara.

Cow Case crossover! Catanzara is the Chicago cop who's been at the center of the ongoing legal disputes over the mandates as applied to CPD I've covered before, and his case also relies on this unique IL statute.

The governor signed an amendment to Illinois’ decades-old Health Care Right of Conscience Act Nov. 8 allowing employers to discipline employees for refusing to comply with COVID-19 rules. The amendment was intended to narrow the law and deny it as a legal argument to groups such as the 88 teachers, but the changes do not take effect until June 1, 2022.

But OwO what's this? This amendment hasn't gone live yet. The teachers' class action still has a chance, and is now a ticking clock story. How dramatic.
