They remain professional, but they don't go out of their way to be tactful. Rather than just pointing out that Russell's legal claims are invalid, they explicitly identify him as a deranged creepazoid.
They don't want to argue the legal merits because the only issue is that the Federal Arbitration Act requires the court not even to look at the merits. The question is simply did Greer sign a contract with a valid arbitration clause, and is this sort of case covered by it. They've established both of them, and Greer admits he signed on the dotted line. The only question is the clause valid, and Greer offers absolutely nothing as to why it is. He's not arguing I didn't sign this, but I did sign this but REEEEEEE muh trauma lumps.

Once that's established, unless he can establish the clause is somehow unconscionable (a nearly impossible standard to meet and this contract is nowhere near unconscionable), or made under duress (they had a gun to his head or the like), the court really lacks any power to do anything but send it to arbitration, period.

I did not immediately hang up on his frequent and deranged phonecalls as I was young still thought it was important to be polite to one's opposing litigants in person). So this is absolutely a thing. I know I'm going to end up breaking down these documents in another post to point out my favorite bits, but for now we're playing catch up!

We knew about all the lawsuits against Farrah, Ariana, and Murphy, but we never had access to the complaints before. Same thing with his first small claims suit against Taylor. So that's all new material for us, as are all the restraining orders. We didn't even know about the restraining order against the second individual from the Mustang Ranch until now!

The dumbass actually turned down an offer to arbitrate if they paid his half of the fee. I bet, though, if he makes them go through this farce in court and spend time on a MtC, that offer evaporates.

I literally laughed out loud when I came to that part of the filing. Then I saw the exhibits and found out that he's the one who suggested that offer to begin with, that Fremantle/Marathon agreed to it, and then he immediately backed out of the offer that was his own idea! :story: Exhibit #12,038 on how all of Russhole's legal wranglings are done in bad faith. I hope you're right and that Fremantle/Marathon will make him pony up his half of the fee now, because he absolutely deserves the scorched earth treatment from them at this point.

My background is in psychology, not law, but the way Russ describes thinking Abraham agreed to his date even though she never once directly addressed him is delusional thinking at its finest. This is just like him thinking he got on AGT because the producer said "good job." He reads things that are objectively not there into people's actions.

It's right up there with all of his allegations about Taylor Swift giving him "subtle invitations" to "woo" her by her accepting gifts from other fans, how he just knew that the reason he was evicted or fired was because of Tay-Tay even though his boss/landlord said absolutely nothing about her, and his assertions that he could just tell Ariana Grande's security team members all wanted to kill him (solely because of his disability, natch) because one of them asked him where his seat was. Not to mention how everyone who ever tells Russhole no or to stop doing something he's not supposed to is "screaming" at him.

Did we know the names of Tara Adkins and Murphy Walters before these filings, from the two restraining orders issued against him by Reno Justice Court? I did a quick thread search but it's sometimes broken because this thread is so unwieldy.

We knew about Murphy's first name, because Russhole disclosed it in his "Why I Sued Taylor Swift" book. But I believe we didn't have her last name before this filing, and we definitely didn't know anything about this Tara Adkins until now. To my recollection, Russhole has never mentioned a second sex worker who had a restraining order against him.

That's what I was a little confused about, didn't Farrah (or whoever runs her SM accounts) just like a single post he made, and he assumed he had won the date with her based on that single like?

We believed that because that's what Russhole's social media posts on the subject led us to believe. His lawsuit against Farrah came well before he had a thread on the Farms, so that portion of his lolcow saga is poorly documented. Now for the first time we can see his entire original narrative about why he thought he was owed money and having him his dick sucked by Farrah. The whole story is almost exactly a one to one equivalent to his original Taylor Swift lawsuit; he even cut and pasted entire sections from his Farrah lawsuit and used them in his first Taylor lawsuit, just changing out the names; I'll be breaking those similarities down in a later post.

I had a feeling Freemantle would do this. Big companies will spend thousands to avoid developing a reputation for paying out a frivolous lawsuit. They not only want to make Russ go away, they want to make sure he knows he's been defeated. Dragging out all his dirty laundry is the way to do it, because now it's all in one place for anyone who has to deal with him in the future to look up.

Including any of those (likely imaginary, let's be real) reporters that Russhole referenced talking to as an attempt to threaten Fremantle/Marathon with bad press! Ms. Lens and her law firm were absolutely calling Russhole's bluff/empty threat there. So go ahead Russhole! Go cry to some journalist about how you're being discriminated against by those Hollywood insider meanies! Point them at this lolsuit and let them find out about your years long history of stalking and harassing women! I'm sure that will go splendidly for you, and they will surely write a super sympathetic article about MUH PLIGHTS! :popcorn:

Even if they somehow didn't catch on from his original complaint (where he talked about writing his audition song to "flatter" Heidi Klum), Russhole couldn't help himself from making his true intentions blatantly obvious by constantly begging to play his song for Heidi Klum in exchange for dropping his lolsuit. Once again Russhole is his own worst enemy.

The same person who feels the need to explain every "joke" he writes to make sure everyone knows how "clever" he is.

This is 100% what Russhole thinks it means. He thinks him suffering from a (in the grand scheme of things) minor disability should function as an everything-proof shield against all rejection, insult, and consequences for his own actions. You have to be nice and play with Russhole, because he's disabled and the teacher said so! You have to give in to Russhole's legal demands, because he's disabled and the judge said so!

The fact that Russhole figured Freemantle would not want to pay for his share of the arbitration fees and drop their request when they are paying the lawyers dealing with his bullshit the entire amount of the cost of arbitration every few fucking billable hours shows just how clearly Russ misunderstands the stakes of the game he is playing with them for all his claiming that he belongs 'in The Biz'.

I also see it as yet another example of the malignant narcissist's lack of theory of mind. Russhole can't put himself in anyone else's shoes, because he doesn't see other people as real. So he just projects his own thoughts and desires onto them, then tard rages when they don't behave like good NPCs in his dating sim. Russhole doesn't want to pay arbitration fees and sees having to pay them as unfair and a threat, so he couldn't conceive how for Fremantle/Marathon paying said fees would be no big deal.

It's quite the strategy to admit that KF didn't give you PTSD in a legal document while simultaneously suing the owner of KF for giving you PTSD (under the guise of a copywriter claim). Russ never disappoints

As all the new documents provided in this filing prove, Russhole has repeatedly recycled the same bogus claims against every person he sues. Going all the way back to his Farrah lolsuit, he tries to paint whoever he's currently suing as the sole cause of all of his woes. When he sued Farrah, he claimed she was the reason he lost his job at TraskBritt. When he sued Taylor, suddenly it was all Taylor's fault! Then when he sued Null, then suddenly he lost that job because of "Kiwi Orchards trolls." And so on and so forth.
 
Fortunately, I’m pretty sure that at this point, Russell has realized that his lawsuits are quickly reaching a dead-end and will be dropping them before he loses and has to pony up money. He realizes at this point that he’s completely ruined his reputation.

I'm not sure anything here is particularly relevant enough that it'd be worth paying Skordas to put it in the appellate response.
This will provide little to aid in getting Russ's current lawsuit tossed. But Freemantle does nicely catalog why Russ is a Public Figure and worthy of public comentary, critique, and ridicule and satire. It does show the strength of a Fair Use defense with regard to Russ.
Literally could not be more irrelevant given that Fair Use wasn't even brought up by the defendant or the judge. Appeals are about correcting district court's errors in regards to matters of law. The district court neither heard any Fair Use questions, nor ruled on them.
Yeah, since the appeal is only focusing on the copyright issue, there's not a lot here that will help, other than establishing that Russ frequently (almost always) files in bad faith.
That is incorrect. The appeal is not "only focusing on the copyright issue". Here's what Russ' lawyers said they will focus on:

I'd love to hear the other side of the story from many of the people, both named and unnamed, in all of the previous lolsuits.

The one that makes me wonder the most is the Ariana Grande suit. The way Russhole describes the alleged behaviour of Ariana, her staff, her security and her management is absolutely preposterous. As if anyone could hear security staff having a quiet conversation over the sound of a concert in an arena filled with tens of thousands of screaming teenage girls.

Then there's the stuff about Russhole giving Ariana's people the heads up about his disability prior to the meet and greet. Ensuring the venue was accessible for one of Ariana's wheelchair-bound fans makes perfect sense... but what physical accommodations (heh) would someone with Mobius attending a meet-and-greet actually need? The only one I can think of is a spit hood. Be careful what you wish for, Russ...

I think will be even worse than that. He's going to be harassing both of the lawyers on this case non-stop about them bringing up his past misdeeds, and how they can't force him to go to arbitration. I think we may end up with Russ getting slapped with two more restraining orders as well as him being forced to pay costs and fees.
The only thing that concerns me about Russhole getting his shit pushed in by AGT's lawyers is that he might somehow take it out on Null, especially if the AGT door is completely shut. I'm thinking along the lines of another defamation suit, only this time focused entirely on discussion surrounding the AGT case and the documentation that's come to light as a result.*

Whilst it'd give the Orchards a bumper 2022 harvest, it'd put an even bigger strain on Null's resources.
