It is. Every single setback suffered by Vikki and Dean to date has been related to their own stupidity or ignorance regarding proper or recommended legal procedure. Not the merits, or distinct lack thereof, of this case.

Not really. They could have filed something called a joinder which is generally a brief statement incorporating another party's arguments by reference. You still have to explain why the legal issues are similar enough that the same arguments apply.

At least with Dean the personal jurisdiction issues are more or less the same. Zero contact with the forum state, personal jurisdiction asserted solely on the basis of where the plaintiff is, etc. It's literally a stereotype of the kind of bullshit forum shopping case every 1L civ pro student reads dozens of.

Vikki's issue also had to do with service of process which she says was defective. I think the personal jurisdiction argument would have worked for her too.

Incidentally when I was watching this go down I didn't think filing the answer was as disastrous as it turned out to be because I assumed it was an actual strategic decision and not random flailing. I also hadn't really looked into it seriously, but while there are exceptions to the general rule of always filing one of the dispositive 12(b) motions before or included in an answer, they're a lot more narrow than I thought.

For instance, an amended complaint could introduce new facts or arguments that make it clear there's a personal jurisdiction issue that couldn't have been raised in the first responsive pleading. Another example is if an appeals case comes along while the case is pending that revises the state's personal jurisdiction law, such that if you'd previously made such an argument, it would have been contrary to precedent.

And now the case is so fucked up (at least for them) that they're probably going to have to pay a lot more to do it right. I still think the case is weak and if you look at that Demonatrix shit or whatever, it is pedo as hell.
But on the other side, these lawsuits were all stupid in that if properly defended, they would have all failed on the question of jurisdiction.
All the precedent in the 5th Circuit (including Texas) was against jurisdiction being granted in this case.
Hell for another example from a District Court in Texas, look at Meyer v. Waid. They literally only granted jurisdiction over the one defamation claim about slander uttered by Waid while he was physically present in Texas. That is how hostile Texas generally is to just hearing random shit from the Internet where the only basis for jurisdiction is one of the parties is there.

Unless you actually wanted to fight the case on the merits to avoid some whack-a-mole game where that pegged cuck just files suit in one jurisdiction after another, that was obviously the right move.

The problem is that a sociopath with money can do a lot of damage before being brought to account. Look to politicians and Hollywood. I don't think D&V's 283 subscribers are equivalent enough power to bring down FROG, which makes this crusade they're waging against him now especially pointless, IMO. It also distracts from more important things they could and should be doing.

The only karma that would befit him would be if he wasted all of his fortunes against @FROG and loses in the end.

And now here were are a month later, the day before another deadline. He still doesn't officially have any representation, and he's doing a livestream featuring videos he produced about "Evan Scam Cryver" and commenting that Ethan is a, "fat incompetent liar", "closeted homosexual", and "fat faggot weirdo."

What an absolute train wreck Dean turned out to be.

It's Tuesday, 22 February 2022 in Texas. The day before the conference on Wednesday.

Something that Dean said recently to Mockulous/Pods didn't sit well with me.
When asked if he got Spectre to write his response he said "I had Spectre write up what I wanted and that was it. I didn't ask him for advice."
To me, this doesn't make sense. Ethan Van Scriver got a lawyer and had the case dismissed because it was in the wrong jurisdiction and it seems like Dean could have easily gotten that result too if he had signed on to that motion to dismiss.

Dean and Vikki have been treating the legal system like it's their gay comics YouTube channel. They have been trying to save face instead of actually facing reality and working within the system. Dean did an interview with some random dude in a discord server before he hired a lawyer. This is insane. How many hours of content about @FROG did Dean and Vikki stream before they'd secured legal representation? I'm not your nigger so I'm not going to add it up. I already fetched you those months old posts from Null but judging by how much Vikki tweets about him it's probably a LOT.

All roads lead back to Spectre and I have to say it's pretty fucking funny.

I didn't "get" that video. At one point he was even complaining about how Crow doxed him around the time of the lawsuit, but when you get sued the clerk of the court basically "doxes" you because civil lawsuits are public record. We then rely on that record to follow a lawsuit in threads such as these. Ultimately, the person who set things in motion to have Dean doxed is Preston.

It's like they don't get anything about this process at all.

That second part is particularly incongruous with Dean's claim that Spectre only wrote what Dean wanted. Per Spectre, he was absolutely doing work that is properly the purview of a lawyer.

Either Dean is willfully ignorant of what Spectre claimed here on KF and Spectre is wrong, or Spectre is telling the truth and Dean is (badly) trying to spin it.

When you have the site owner (Null) doing videos about how awful Spectre's boasting here looks, you can't really just hand wave this away or claim it's the conspiracy theory of a few idiots.

Either way, the whole sad truth will probably end up coming out in discovery. And alot more beyond that. As has been said before, Spectre was
doing what is in the purview of an attorney, but with no protections or privilege. I can't even imagine what Spectre will say about himself and
about his role in these matters if they start asking him questions.

It's because, as @5t3n0g0ph3r points out in the OP, this is the first time in site history a Kiwi (however superficially so) has actually sued not one, but two Kiwis.

THEN another Kiwi (since halal'd) decided they were gonna become a lawyer and directly involve themselves in the drafting of legal filings in this case. Not go to law school and pass the bar exam or anything like that... just magically become qualified to draft documents and give legal advice. Because apparently that's a thing you can and should do.

This either coincided with, or was directly attributed to the creation of the Captain Specks thread which was an absolute dumpster because of the image pasting glitch during the time, the thread was also a Discord collaboration. People who were following this stuff made the thread.

Due to captain gas pipe's involvement in the Vickers debacle, it set off numerous alarms and came off as gayops. People who are accustomed to the Gunt Subforum's culture immediately questioned it. Seems like getting personally involved in Discord isn't frowned upon as much here, and I have no problems respecting that.

So we (Gunt subforum jannies) then tried pretty hard to keep the thread up and moved it away from Discord, this angered the group behind the thread even though one of their members got it, and has been doing a great job at upkeep. The group blamed @Captain Manning initially, but then decided it was Dean who leaked the chatlogs? That "hey babe" shit didn't do us any favours of course.

While I am fairly certain it wasn't Dean who gave me those files, he seized this opportunity and tried to do some kind of "gayops xposed" video with Surfer, which backfired in his face.

Dean was personally invested in Captain Specks 06 and wanted to manufacture a piece to defend the captain's honour and run damage control? I have many issues with that. Speak for yourself.

So a pozloading my neghole captain and his "client" caused so much headaches and infighting drama. Good fucking riddance, no regrets making sure your thread stayed up.
