They're citing attorney-client privilege (note that this is still Thornley) but the mere fact of communication with counsel or that you are represented by counsel is not itself privileged. Cell site location information has no particular reason to be privileged. I could see excluding anything with an actual privilege, like attorney-client calls to or from a limited set of numbers, but I'm not sure even of that. The argument would have to be that somehow knowing when he talked to counsel, and where he was when he did it, is itself privileged, because the government isn't even asking for wiretap information, just the kind of shit they could get with a National Security Letter or a pen trace. (And you better believe they already did that and know exactly what's in it already. They just want something admissable that can be verified as business records.)
