sure american politicians can say "nuh-uh they're not really our soldiers" but it will look a lot like back in 2014 when russia said "nuh-uh those aren't actually russian soldiers" when armed russians in combat gear started appearing in crimea to prepare and execute its separation from ukraine (and later its annexiation to russia)

And they can tell the difference between trained US special forces and troons who served in an army kitchen. You can bet your ass if they find actual US forces they'll raise hell about it. i'm not saying that this is happening, i'm saying that this is what it will probably look like to the russians who encounter these foreign fighters.

It doesn't matter what international courts decide. If Russia wants to treat them as unprotected, that's what they'll do. No country can stop them as their citizens are criminals going to go murder Russians of their own accord. They are volunteers. They can't be mercenaries without being paid by the very definition of the word. Look through the history of every war since the 17th century. People volunteered to fight in wars. They are just called volunteers. Usually because they hated commies, or fascists, or the English. In any case, even if it weren't true, what are they, if not mercenaries? Foreign nationals, not in the Ukrainian military, not serving members of a different military, actively engaged in the hostilities, being armed and supported by the Ukrainian government? Is the question of payment really the only thing preventing them from being considered "mercenaries" officially? Do the Geneva Conventions have a different title for them if they do it for free?
