I’m no expert on the law, but I imagine Nick would have to be aware that the victim was in danger. All he did was hear her scream and that could’ve happened because she saw a mouse or a spider running across the floor. The way Nick reacted to her screaming probably would’ve been the way any of us reacted… you know, if we were obese youtubers who filmed ourselves crying while eating ourselves to death.

Nick made a video on his Instagram pointing it out. Imagine this video being evidence used in the court of law. They have to sit and hear Nick burping in between the screams.

Since no one gave you a concrete answer - no. A duty to rescue is only applicable where you have a reasonable expectation of care. So if you see someone drowning in the pool, you're not compelled to jump in and save them, or even call 911. However, if you were say a lifeguard on Duty, and someone was drowning and you chose not to attempt to save them, then you could be held personally liable for their death.

Nico doesn't even seem to be aware that someone is screaming in the background during this. Assuming that he could've done something to save her, he doesn't even appear aware that she is in danger. Which is kind of why these laws exist right? Like we can tell from this footage that Nico doesn't seem aware that she was being stabbed, but imagine if this footage didn't exist? Would we want to hold everyone within earshot of a murder victim to go to jail or be sued just because they didn't rush into harms way, when they potentially didn't even realize a crime had been committed?

Back in my undergrad, I had to take a handful of legal classes. My biggest take away was that at the end of the day, the law tends to just make sense. Maybe you don't agree with every law, but unless you're a multi-billion dollar international company, or a fringe case, the correct answer is usually the one that holds people responsible where it can, and doesn't try to force people to do things that are unnatural.
