There are people who are in relationships with fellow inmates in prison, but no prison condones it and will write up prisoners for any form of PDA or sex because of the non-zero chance that one of them does not consent.

.....It already is not allowed in all state/federal and I'm assuming most/all private prisons.

Even for the non-romantic side, it's banned because touch can be used to exchange contraband which is the more likely scenario and likely the overwhelming majority of all salacious touches. The ACLU has basically no sway within prisons because if they did, change would have already happened to things that are ACTUALLY offensive like conditions of cells of inmates/rehabilitation programs post-incarceration to lessen the 75% recidivism rate American prisons have.

They're basically thew equivalent of a yappy miniature dog when it comes to getting anything done in prisons because nobody wants to pay for it. Especially when there's so many bigger fish to fry.
