The structure of the federal judiciary is atrociously broken and needs to be fixed but it won't be until the pain is too much to withstand.
Does anyone who knows anything about the Ninth Circuit think this gigantic cancerous tumor of a Circuit is actually good or functioning properly? I think it should be broken down and its powers should be devolved into as many as three or even four Circuits as powerful as an average federal Circuit court. I think the liberal states in the new Circuits should be represented by jurists similar to those states, and the conservative states, currently bizarrely shoved into the Ninth Circuit, like fucking ALASKA?, should get represented in a Circuit with conservatives.
The general concept is people should, as they are in the legislature, have judges that at least somewhat represent the constituency, rather than being aliens from 1,000 miles away (this is about Alaska and the Ninth Circuit).
Nobody ever seemed to get it anywhere I pointed out Roe v. Wade was already overruled the instant the whole trimester model was thrown out. Even actually doing it now means nothing. It's not a new overruling, it's just a recognition of the fact it already was overruled sub silentio while pretending to adhere to stare decisis, something only Roberts seems to give a shit about these days.

That'd be the part that violated the due process and equal protection clauses (domestic partnerships, being an equal-but-separate thing in some states violated precedent set in Brown v Board of Education, which knocked down "separate but equal" doctrine, but that's a side issue).
It violates those in the same exact way interracial marriage bans did (people were "free to marry anyone of the same race" after all).
It's not the marriage part that's violative, it's the "who you can marry" part that is.

Perennial failure of the 'rainbow coalition' to emerge is one of my favorite quirks of the American left's way of thinking. What boggles my mind is that they clung to it for so long in a country that's aging and whose immigrant-descended population is (outside of family reunification policies) pretty strongly anti-immigration.

On one hand in general I believe in states rights, on the other hand the vast majority of women getting abortions are not the type to be raising children to be good and productive adults. They don’t want to/don’t feel capable of being a mother. Okay, fair enough, better to acknowledge that than to raised another neglected/abused/generally fucked up person. We’ve got enough of those as is.
