IANAL, but I would suspect this if he was on parole or probation. As it's just a suspended sentence, it would have to come to the courts attention, and the court would decide if there's a violation. Normally, I'd say "no, probably not." But I can't imagine the judge loves him, either.

Without a doubt, some turbo-sped has faxed and forwarded every clip to the court/vicker's lawyer/the town drunk/etc. So don't bother. Just wait and see. Celebrate later.

But let's be honest. If it happens, we don't get Knoxville 2.0.

To paraphrase, basically it's near impossible to prove the offender is using DMCA as a mechanism illegally and there is no precedence for such utilisation of the takedown being criminally prosecuted, or the offender being held liable for business losses.
